There is hereby established within the State Department\n\nof Health, an organ, eye and tissue donor registry for the State of\n\nOklahoma to be known as the “Life Share Donor Registry”. The\n\nDepartment is authorized to contract with the designated organ\n\nprocurement organization who shall act on behalf of the Department\n\nby carrying out the functions of the Department in the\n\nadministration of the registry, in compliance with 18 U.S.C. Section\n\n2721. The contract between the Department and the designated organ\n\nprocurement organization shall be subject to the concurrence and\n\napproval of the Department of Public Safety.\n\n2. The registry shall maintain and update as needed the\n\npertinent information on all Oklahomans who have indicated a\n\nwillingness to be an organ donor, eye donor or tissue donor by a\n\ndesignation on a driver license, a state identification card, a\n\ndonor card, an online or other organ donor registry enrollment form,\n\nor any other document of gift.\n\n3. The registry and all information therein shall be\n\nconfidential and shall be subject to access only by the designated\n\norgan procurement organization and by eye banks and tissue banks\n\nlicensed by the State of Oklahoma seven (7) days a week, twenty-four\n\n(24) hours per day; however, the personal information and highly\n\nrestricted personal information shall only be available to the\n\ndesignated organ, tissue, and eye procurement organizations solely\n\nfor the purpose of identifying a potential donor and only when\n\nacting on behalf of the State Department of Health as prescribed in\n\nparagraph 1 of this subsection. The placement of any personal\n\ninformation and highly restricted personal information on the\n\nregistry that, at the time of placement, was confidential under the\n\nOpen Records Act or the Driver’s Privacy Protection Act (DPPA), 18\n\nU.S.C. Sections 2721 through 2725, shall remain confidential.\n\n4. The purpose of the registry shall include, but not be\n\nlimited to:\n\na. providing a means of recovering an anatomical gift for\n\ntransplantation or research, and\n\nb. collecting data to develop and evaluate the\n\neffectiveness of educational initiatives promoting\n\norgan, eye and tissue donation.\n\nB. Procedures to administer the Life Share Donor Registry shall\n\nspecify:\n\n1. The information placed in the registry may include personal\n\ninformation and highly restricted personal information, as defined\n\nin 18 U.S.C. Section 2721, and access to such information shall\n\nconform to the Driver’s Privacy Protection Act (DPPA), 18 U.S.C.\n\nSections 2721 through 2725;\n\n2. Authorization for the designated organ procurement\n\norganization or an eye or tissue bank, licensed by the State of\n\nOklahoma, to analyze registry data under research protocols directed\n\ntoward determination and identification of the means to promote and\n\nincrease organ, eye and tissue donation within this state;\n\n3. A process for updating information in the registry including\n\na method whereby an individual may revoke his or her intent to be an\n\norgan, eye, or tissue donor;\n\n4. The method for making information on the registry available\n\nto the designated organ procurement organizations and to tissue\n\nbanks and eye banks licensed by the State of Oklahoma;\n\n5. Limitations on the use of and access to the registry;\n\n6. A toll-free telephone number, available twenty-four (24)\n\nhours a day, for use by the public to obtain information on becoming\n\nan organ, tissue or eye donor;\n\n7. A process for establishing, implementing, maintaining, and\n\nadministering an online organ, eye and tissue donor registration\n\nprocess and ensuring the confidentiality of information provided;\n\n8. A process for a donor who has registered online to sign a\n\nconfirmation card that will be returned to the designated organ\n\nprocurement organization and made part of the registry record; and\nPage 1366\n\n7. A process for establishing, implementing, maintaining, and\n\nadministering an online organ, eye and tissue donor registration\n\nprocess and ensuring the confidentiality of information provided;\n\n8. A process for a donor who has registered online to sign a\n\nconfirmation card that will be returned to the designated organ\n\nprocurement organization and made part of the registry record; and\n\n9. Procedures for collaborating with the Department of Public\n\nSafety to transmit stored driver license data by the Department of\n\nPublic Safety, in conformance with 18 U.S.C. Section 2721, to the\n\nLife Share Donor Registry maintained by the designated organ\n\nprocurement organization, and to ensure the confidentiality of such\n\ninformation for present and potential donors. Monies credited to\n\nthe Oklahoma Organ Donor Education and Awareness Program Revolving\n\nFund created in Section 2220.3 of Title 63 of the Oklahoma Statutes\n\nmay be used for a one-time transfer to the Department of Public\n\nSafety for the reasonable costs associated with the initial\n\ninstallation and setup of equipment and software for electronic\n\ntransfer of donor information. All actual electronic transfers of\n\ndonor information shall be at no charge to the designated organ\n\nprocurement organization; however, all costs associated with the\n\ncreation and maintenance of the Life Share Donor Registry shall be\n\npaid by the designated organ procurement organization.\n\nC. Information obtained by the designated organ procurement\n\norganization shall be used for the purpose of:\n\n1. Establishing a statewide organ, eye, and tissue donor\n\nregistry that is accessible to designated organ procurement\n\norganizations and to eye banks and tissue banks, licensed by the\n\nState of Oklahoma, for the recovery, preservation, transportation,\n\nand placement of organs, eyes, and tissue; and\n\n2.
