As used in this section:\n\n1. “Advance health care directive” means a power of attorney\n\nfor health care or a record signed or authorized by a prospective\n\ndonor containing the prospective donor’s direction concerning a\n\nhealth care decision for the prospective donor;\n\n2. “Declaration” means a record signed by a prospective donor\n\nspecifying the circumstances under which a life support system may\n\nbe withheld or withdrawn from the prospective donor; and\n\n3. “Health care decision” means any decision regarding the\n\nhealth care of the prospective donor.\n\nB. If a prospective donor has a declaration or advance health\n\ncare directive and the terms of the declaration or directive and the\n\nexpress or implied terms of a potential anatomical gift are in\n\nconflict with regard to the administration of measures necessary to\n\nensure the medical suitability of a part for transplantation or\n\ntherapy, the prospective donor’s attending physician and prospective\n\ndonor shall confer to resolve the conflict. If the prospective\n\ndonor is incapable of resolving the conflict, an agent acting under\n\nthe prospective donor’s declaration or directive, or, if none or the\n\nagent is not reasonably available, another person authorized by law\n\nother than this act to make health care decisions on behalf of the\n\nprospective donor, shall act for the donor to resolve the conflict.\n\nThe conflict must be resolved as expeditiously as possible.\n\nInformation relevant to the resolution of the conflict may be\n\nobtained from the appropriate procurement organization and any other\n\nperson authorized to make an anatomical gift for the prospective\n\ndonor under Section 9 of this act.
