Stat. tit. 63, § 63-2200.2A","heading":"Definitions","body":"As used in the Oklahoma Uniform Anatomical Gift Act:\n\n1. \"Adult\" means an individual who is at least eighteen (18)\n\nyears of age;\n\n2. \"Agent\" means an individual:\n\na. authorized to make health care decisions on the\n\nprincipal's behalf by a power of attorney for health\n\ncare, or\n\nb. expressly authorized to make an anatomical gift on the\n\nprincipal's behalf by any other record signed by the\n\nprincipal;\n\n3. \"Anatomical donor program\" means an entity that is\n\nregistered with the State Anatomical Board to receive and issue\n\nbodies or body parts for education or research;\n\n4. \"Anatomical gift\" means a donation of all or part of a human\n\nbody to take effect after the donor's death for the purpose of\n\ntransplantation, therapy, research, or education;\n\n5. \"Decedent\" means a deceased individual whose body or part is\n\nor may be the source of an anatomical gift and includes a stillborn\n\ninfant and, subject to restrictions imposed by any other provisions\n\nof law, a fetus;\n\n6. \"Disinterested witness\" means a witness other than the\n\nspouse, child, parent, sibling, grandchild, grandparent, or guardian\n\nof the individual who makes, amends, revokes, or refuses to make an\n\nanatomical gift, or another adult who exhibited special care and\n\nconcern for the individual and does not include a person to whom an\n\nanatomical gift could pass under Section 2200.11A of this title;\n\n7. \"Document of gift\" means a donor card or other record used\n\nto make an anatomical gift, including a statement or symbol on a\n\ndriver license, identification card, or donor registry;\n\n8. \"Donor\" means an individual whose body or part is the\n\nsubject of an anatomical gift;\n\n9. \"Donor registry\" means a database that contains records of\n\nanatomical gifts and amendments to or revocations of anatomical\n\ngifts;\n\n10. \"Driver license\" means a license or permit issued by the\n\nDepartment of Public Safety to operate a vehicle, whether or not\n\nconditions are attached to the license or permit;\n\n11. \"Eye bank\" means a person that is licensed, accredited, or\n\nregulated under federal or state law to engage in the recovery,\n\nscreening, testing, processing, storage, or distribution of human\n\neyes or portions of human eyes;\n\n12. \"Guardian\" means a person appointed by a court to make\n\ndecisions regarding the support, care, education, health, or welfare\n\nof an individual and does not include a guardian ad litem;\n\n13. \"Hospital\" means a facility licensed as a hospital under\n\nthe law of any state or a facility operated as a hospital by the\n\nUnited States, a state, or a subdivision of a state;\n\n14. \"Identification card\" means an identification card issued\n\nby the Department of Public Safety;\n\n15. \"Know\" means to have actual knowledge;\n\n16. \"Minor\" means an individual who is under eighteen (18)\n\nyears of age;\n\n17. \"Organ procurement organization\" means a person designated\n\nby the Secretary of the United States Department of Health and Human\n\nServices as an organ procurement organization;\n\n18. \"Non-transplant tissue bank\" means an entity that is\n\nregistered with the State Anatomical Board to engage in the\n\nrecovery, screening, testing, processing, storage, or distribution\n\nof tissue for education and research;\n\n19. \"Parent\" means a parent whose parental rights have not been\n\nterminated;\n\n20. \"Part\" means an organ, an eye, or tissue of a human being\n\nand does not include the whole body;\n\n21. \"Person\" means an individual, corporation, business trust,\n\nestate, trust, partnership, limited liability company, association,\n\njoint venture, public corporation, government or governmental\n\nsubdivision, agency, or instrumentality, or any other legal or\n\ncommercial entity;\n\n22. \"Physician\" means an individual authorized to practice\n\nmedicine or osteopathy under the law of any state;\n\n23. \"Procurement organization\" means an eye bank, organ\n\nprocurement organization, or tissue bank;\n\n24. \"Prospective donor\" means an individual who is dead or near\ncorporation, government or governmental\n\nsubdivision, agency, or instrumentality, or any other legal or\n\ncommercial entity;\n\n22. \"Physician\" means an individual authorized to practice\n\nmedicine or osteopathy under the law of any state;\n\n23. \"Procurement organization\" means an eye bank, organ\n\nprocurement organization, or tissue bank;\n\n24. \"Prospective donor\" means an individual who is dead or near\n\ndeath and who has been determined by a procurement organization to\n\nhave a part that could be medically suitable for transplantation,\n\ntherapy, research, or education and does not include an individual\n\nwho has made a refusal;\n\n25. \"Reasonably available\" means able to be contacted by a\n\nprocurement organization without undue effort and willing and able\n\nto act in a timely manner consistent with existing medical criteria\n\nnecessary for the making of an anatomical gift;\n\n26. \"Recipient\" means an individual into whose body a\n\ndecedent's part has been or is intended to be transplanted;\n\n27. \"Record\" means information that is inscribed on a tangible\n\nmedium or that is stored in an electronic or other medium and is\n\nretrievable in perceivable form;\n\n28. \"Refusal\" means a record created under Section 2200.7A of\n\nthis title that expressly states an intent to bar other persons from\n\nmaking an anatomical gift of an individual's body or part;\n\n29. \"Sign\" means, with the present intent to authenticate or\n\nadopt a record, to:\n\na. execute or adopt a tangible symbol, or\n\nb. attach to or logically associate with the record an\n\nelectronic symbol, sound, or process;\n\n30. \"State\" means a state of the United States, the District of\n\nColumbia, Puerto Rico, the United States Virgin Islands, or any\n\nterritory or insular possession subject to the jurisdiction of the\n\nUnited States;\n\n31. \"Technician\" means an individual determined to be qualified\n\nto remove or process parts by an appropriate organization that is\n\nlicensed, accredited, or regulated under federal or state law,\n\nincluding an enucleator;\n\n32. \"Tissue\" means a portion of the human body other than an\n\norgan or an eye and does not include blood unless the blood is\n\ndonated for the purpose of research or education;\n\n33. \"Tissue bank\" means a person that is licensed, accredited,\n\nor regulated under federal or state law to engage in the recovery,\n\nscreening, testing, processing, storage, or distribution of tissue;\n\nand\n\n34. \"Transplant hospital\" means a hospital that furnishes organ\n\ntransplants and other medical and surgical specialty services\n\nrequired for the care of transplant patients.","path":["OK
