Stat. tit. 63, § 63-2409","heading":"Appointment of interpreter in court action or grand jury","body":"proceeding.\n\nA. In any case before any state or local court or grand jury,\n\nwherein a person who is deaf or hard-of-hearing is a litigant,\n\ndefendant, spectator as required by subtitle A of Title II of the\n\nAmericans with Disabilities Act, Pub. L. 101-336, witness, party,\n\nprospective juror, or juror, the court shall, upon request, appoint\n\na qualified legal interpreter to interpret the proceedings to the\n\ndeaf or hard-of-hearing person and interpret testimony or statements\n\nand to assist in preparation and communication with counsel within\n\nthe context of the court proceeding. The court shall not be\n\nresponsible for providing an interpreter for attorney-client\n\ncommunications which are not immediately ancillary to the court\n\nproceeding or for meetings at the private counsel's office. The\n\nindividual who is deaf or hard-of-hearing shall determine which type\n\nof qualified legal interpreter or captioning best fits the needs of\n\nthe individual.\n\nB. Efforts to obtain the services of a qualified legal\n\ninterpreter with the highest available level of certification, skill\n\nand specialized training in the area of legal interpretation for the\n\ndeaf or hard-of-hearing will be made prior to accepting services of\n\nan interpreter with lesser certification and skill. Once a\n\nqualified legal interpreter is appointed, the interpreter shall be\n\nafforded the time necessary to make a language assessment in order\n\nto ensure effective communication, and to assess whether a deaf\n\ninterpreter may also be necessary. Based on the language\n\nassessment, the interpreter will make recommendations to the court.\n\nC.
