Any agency making decisions on utilization management\n\nmeasures, coverage, reimbursement or incentive programs shall be\n\nrequired to consult with:\n\n1. Organizations representing patients and people with\n\ndisabilities, including both self-advocacy organizations and\n\norganizations representing patients, prior to proceeding on any\n\nmeasure likely to impact the relevant patient or disability\n\ncommunity; and\n\n2. Organizations representing patients and people that advocate\n\nfor the rights of patients to obtain treatment without regard to the\n\npatients' quality of life and representatives of organizations that\n\nadvocate for the rights of older persons to receive health care.\n\nB. Any agency making decisions on utilization management\n\nmeasures, coverage, reimbursement or incentive programs shall ensure\n\nthat a process is in place to ensure robust stakeholder engagement\n\nand full transparency surrounding the provision of any research and\n\nanalysis relied upon for decision-making that would impact access to\n\nhealth care treatments and services by patient groups provided for\n\nin subsection A of this section, including:\n\n1. Providing stakeholders with meaningful notice and\n\nopportunity to comment on the retention of any vendor providing\n\nresearch and analysis to the agency;\n\n2. Subjecting research and analysis relied upon by an agency to\n\nmeaningful notice and comment process;\n\n3. Ensuring deliberation around the coverage or reimbursement\n\nfor health care treatments and services occurs in open meetings;\n\n4. Presenting and releasing any research and analysis relied\n\nupon for decision-making in public meetings or publicly released\n\nprior to deliberation;\n\n5. Requiring full disclosure into funding sources and conflicts\n\nof interest of any third party providing research and analysis to\n\nthe state;\n\n6. Prohibiting sole-source contracts for research and analysis\n\nto ensure reliance on a range of evidence; and\n\n7. Preparing an annual report assessing beneficiary access to\n\nhealth care treatments and services. The report shall assess the\n\nimpact of any form of utilization management on access to care with\n\na specific analysis of the impact on persons with disabilities,\n\nchronic illness and advanced age. The report shall be submitted to\n\nthe State Legislature, be posted on the state Medicaid website, and\n\nthe agency shall provide an opportunity for public comment.\n\nC. Any research and analysis relied upon for decision-making\n\nthat would impact coverage and access to health care treatments and\n\nservices shall measure outcomes prioritized by patients and persons\n\nwith disabilities as required by this section, as well as consider\n\nmeaningful differences in the characteristics, needs and preferences\n\nof patients and persons with disabilities.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"89688eac643dd4987ec8d43a07335ae05bab3ab115289c748839e21e49947553","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-2564","next":"us-ok/okla.-stat.-tit.-63-63-2601"},"notice":"GroundRules: Original legal text.
