Stat. tit. 63, § 63-2602","heading":"Right of self-consent under certain conditions - Doctor","body":"patient privileges\n\nA. Notwithstanding any other provision of law, the following\n\nminors may consent to have services provided by health professionals\n\nin the following cases:\n\n1. Any minor who is married, has a dependent child or is\n\nemancipated;\n\n2. Any minor who is separated from his parents or legal\n\nguardian for whatever reason and is not supported by his parents or\n\nguardian;\n\n3. Any minor who is or has been pregnant, afflicted with any\n\nreportable communicable disease, drug and substance abuse or abusive\n\nuse of alcohol; provided, however, that such self-consent only\n\napplies to the prevention, diagnosis and treatment of those\n\nconditions specified in this section. Any health professional who\n\naccepts the responsibility of providing such health services also\n\nassumes the obligation to provide counseling for the minor by a\n\nhealth professional. If the minor is found not to be pregnant nor\n\nsuffering from a communicable disease nor drug or substance abuse\n\nnor abusive use of alcohol, the health professional shall not reveal\n\nany information whatsoever to the spouse, parent or legal guardian,\n\nwithout the consent of the minor;\n\n4. Any minor parent as to his child;\n\n5. Any spouse of a minor when the minor is unable to give\n\nconsent by reason of physical or mental incapacity;\n\n6. Any minor who by reason of physical or mental capacity\n\ncannot give consent and has no known relatives or legal guardian, if\n\ntwo physicians agree on the health service to be given;\n\n7. Any minor in need of emergency services for conditions which\n\nwill endanger his health or life if delay would result by obtaining\n\nconsent from his spouse, parent or legal guardian; provided,\n\nhowever, that the prescribing of any medicine or device for the\n\nprevention of pregnancy shall not be considered such an emergency\n\nservice; or\n\n8. Any minor who is the victim of sexual assault; provided,\n\nhowever, that such self-consent only applies to a forensic medical\n\nexamination by a qualified licensed health care professional.\n\nIf any minor falsely represents that he may give consent and a\n\nhealth professional provides health services in good faith based\n\nupon that misrepresentation, the minor shall receive full services\n\nwithout the consent of the minor's parent or legal guardian and the\n\nhealth professional shall incur no liability except for negligence\n\nor intentional harm. Consent of the minor shall not be subject to\n\nlater disaffirmance or revocation because of his minority.\n\nB. The health professional shall be required to make a\n\nreasonable attempt to inform the spouse, parent or legal guardian of\n\nthe minor of any treatment needed or provided under paragraph 7 of\n\nsubsection A of this section. In all other instances the health\n\nprofessional may, but shall not be required to inform the spouse,\n\nparent or legal guardian of the minor of any treatment needed or\n\nprovided. The judgment of the health professional as to\n\nnotification shall be final, and his disclosure shall not constitute\n\nlibel, slander, the breach of the right of privacy, the breach of\n\nthe rule of privileged communication or result in any other breach\n\nthat would incur liability.\n\nInformation about the minor obtained through care by a health\n\nprofessional under the provisions of this act shall not be\n\ndisseminated to any health professional, school, law enforcement\n\nagency or official, court authority, government agency or official\n\nemployer, without the consent of the minor, except through specific\n\nlegal requirements or if the giving of the information is necessary\n\nto the health of the minor and public.
