Stat. tit. 63, § 63-2607.1","heading":"Gender transition procedures for minors prohibited —","body":"Violations — Penalties — Enforcement.\n\nA. As used in this section:\n\n1. \"Child\" means any person under eighteen (18) years of age;\n\n2. a. \"Gender transition procedures\" means the following\n\nmedical or surgical services performed for the purpose\n\nof attempting to affirm the minor's perception of his\n\nor her gender or biological sex, if that perception is\n\ninconsistent with the minor's biological sex:\n\n(1) surgical procedures that alter or remove physical\n\nor anatomical characteristics or features that\n\nare typical for the individual’s biological sex,\n\nor\n\n(2) puberty-blocking drugs, cross-sex hormones, or\n\nother drugs to suppress or delay normal puberty\n\nor to promote the development of feminizing or\n\nmasculinizing features consistent with the\n\nopposite biological sex.\n\nb. Gender transition procedures do not include:\n\n(1) behavioral health care services or mental health\n\ncounseling,\n\n(2) medications to treat depression and anxiety,\n\n(3) medications prescribed, dispensed, or\n\nadministered specifically for the purpose of\n\ntreating precocious puberty or delayed puberty in\n\nthat patient,\n\n(4) services provided to individuals born with\n\nambiguous genitalia, incomplete genitalia, or\n\nboth male and female anatomy, or biochemically\n\nverifiable disorder of sex development (DSD),\n\nincluding but not limited to:\n\n(a) 46,XX DSD,\n\n(b) 46,XY DSD,\n\n(c) sex chromosomes DSDs,\n\n(d) XX or XY sex reversal, and\n\n(e) ovotesticular disorder,\n\n(5) the treatment of any infection, injury, disease,\n\nor disorder that has been caused by or\n\nexacerbated by the performance of gender\n\ntransition procedures, whether or not the gender\n\ntransition procedure was performed in accordance\n\nwith state and federal law,\n\n(6) the treatment of any physical injury or illness\n\nthat would, as certified by a physician, place\n\nthe individual in imminent danger of death or\n\nimpairment of a major bodily function unless such\n\ntreatment is performed, or\n\n(7) the provision of puberty-blocking drugs or cross-\n\nsex hormones to a minor currently receiving such\n\ndrugs or hormones as of the effective date of\n\nthis act for a period of not more than six (6)\n\nmonths solely for the purpose of assisting the\n\nminor with gradually decreasing and discontinuing\n\nuse of the drugs or hormones.\n\n3. “Health care provider” means a physician, physician\n\nassistant, Advanced Practice Registered Nurse, or any other person\n\nwho is licensed, certified, or otherwise authorized by the laws of\n\nthis state to administer health care in the ordinary course of the\n\npractice of his or her profession.\n\nB. A health care provider shall not knowingly provide gender\n\ntransition procedures to any child.\n\nC. A health care provider found in violation of subsection B of\n\nthis section shall, upon an adverse ruling by the provider’s\n\nrespective licensing board, be guilty of unprofessional conduct.\n\nDisciplinary proceedings against the health care provider may be\n\ncommenced at any time after the commission of such offense.\n\nD. A health care provider who violates subsection B of this\n\nsection shall, upon conviction, be guilty of a felony. Prosecution\n\nfor a criminal violation of subsection B of this section shall be\n\ncommenced not later than the date on which the child attains the age\n\nof forty-five (45) years.\n\nE. 1. The parent, legal guardian, or next friend of a child to\n\nwhom a health care provider has provided one or more gender\n\ntransition procedures in violation of subsection B of this section\n\nmay bring a civil action against the health care provider. The\n\nparent, legal guardian, or next friend shall bring a claim for the\n\nviolation no later than the date on which the child attains the age\n\nof majority.\n\n2. A child to whom a health care provider has provided one or\n\nmore gender transition procedures may bring an action throughout his\n\nor her minority through a parent, legal guardian, or next friend,\nivil action against the health care provider. The\n\nparent, legal guardian, or next friend shall bring a claim for the\n\nviolation no later than the date on which the child attains the age\n\nof majority.\n\n2. A child to whom a health care provider has provided one or\n\nmore gender transition procedures may bring an action throughout his\n\nor her minority through a parent, legal guardian, or next friend,\n\nand may bring an action in his or her own name upon reaching\n\nmajority at any time until the date on which the child attains the\n\nage of forty-five (45) years.\n\n3. The court in such action may award compensatory damages,\n\npunitive damages, injunctive relief, or any other appropriate\n\nrelief. Additionally, the court shall award court costs and\n\nreasonable attorney fees to a prevailing party who establishes a\n\nviolation of this section.\n\n4. Notwithstanding any other provision of law, an action under\n\nthis subsection may be commenced, and relief may be granted, in a\n\njudicial proceeding without regard to whether the person commencing\n\nthe action has sought or exhausted available administrative\n\nremedies.\n\nF. The Attorney General may bring an action to enforce\n\ncompliance with this act.
