Stat. tit. 63, § 63-2622","heading":"Definitions","body":"As used in the Medical Savings Account Act:\n\n1. \"Account holder\" means the individual including but not\n\nlimited to an employee of an employer or dependents of the\n\nindividual on whose behalf the medical savings account is\n\nestablished;\n\n2. \"Dependent child\" means any person under the age of twenty-\n\none (21) years or any person who is legally entitled or subject to a\n\ncourt order for the provision of proper and necessary subsistence,\n\neducation, medical care, or any other care necessary for the health,\n\nor well-being of such person, and who is not otherwise emancipated,\n\nmarried or a member of the Armed Forces of the United States, or who\n\nis mentally or physically incapacitated and cannot provide for\n\nthemselves;\n\n3. \"Eligible medical expenses\" means an expense paid by the\n\ntaxpayer for medical care described in Section 213(d) of the\n\nInternal Revenue Code;\n\n4. \"Medical savings account\" or \"account\" means an account\n\nestablished in this state pursuant to a medical savings account\n\nprogram to pay the eligible medical expenses of an account holder\n\nand the dependents of the account holder;\n\n5. \"Medical savings account program\" or \"program\" means a\n\nprogram that includes all of the following:\n\na. the purchase by an individual or employer of a\n\nqualified higher deductible health benefit plan which\n\nis approved by the State Department of Health and\n\noffered by an entity regulated by the State Department\n\nof Health or is approved by the Insurance Commissioner\n\nand offered by an entity regulated by the Insurance\n\nCommissioner or is offered by the State and Education\n\nEmployees Group Insurance Board for the benefit of the\n\nindividual or an employee of the employer and the\n\ndependents of that individual or the employee,\n\nb. the deposit by an individual into a medical savings\n\naccount or the contribution on behalf of an employee\n\ninto a medical care account by an employer of all or\n\npart of the premium differential realized by the\n\nemployer based on the purchase of a qualified higher\n\ndeductible health plan for the benefit of the\n\nemployee. An employer that did not previously provide\n\na health plan or provide a health coverage policy,\n\ncertificate, or contract for employees may contribute\n\nall or part of the deductible of a qualified higher\n\ndeductible health benefit plan; and\n\n6. \"Trustee\" means a chartered state bank, savings and loan\n\nassociation, licensed securities dealer or trust company authorized\n\nto act as a fiduciary; a national banking association or savings and\n\nloan association authorized to act as a fiduciary; or an insurance\n\ncompany.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3ed73d5112e8c03753a647752e2558edb28d1be190c63138c4717795df86dc37","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-2621","next":"us-ok/okla.-stat.-tit.-63-63-2623"},"notice":"GroundRules: Original legal text.
