Stat. tit. 63, § 63-2862","heading":"Definitions","body":"As used in the Oklahoma 9-1-1 Management Authority Act:\n\n1. “Area served” means the geographic area which shall be\n\nserved by the 9-1-1 emergency telephone service provided by the\n\ngoverning body of a county, municipality, part of a county or\n\ncombination of such governing bodies;\n\n2. “Authority” means the Oklahoma 9-1-1 Management Authority\n\ncreated in Section 2863 of this title;\n\n3. “Emergency telephone service” means any telephone system\n\nutilizing a three-digit number, nine-one-one (9-1-1), for reporting\n\nan emergency to the appropriate public agency providing law\n\nenforcement, fire, medical or other emergency services, including\n\nancillary communications systems and personnel necessary to pass the\n\nreported emergency to the appropriate emergency service and\n\npersonnel;\n\n4. “Emergency telephone fee” means a fee to finance the\n\noperation of emergency telephone service;\n\n5. “Governing body” means the board of county commissioners of\n\na county, the city council, tribal authority or other governing body\n\nof a municipality, or a combination of such boards, councils or\n\nother municipal governing bodies including county or municipal\n\nbeneficiary public trusts, or other public trusts which shall have\n\nan administering board;\n\n6. “Landline telecommunications connection” means a ten-digit\n\naccess number assigned to a customer that utilizes analog\n\ncommunications over a wired transmission line that travels\n\nunderground or on telephone poles;\n\n7. “Local exchange telephone company” means any company\n\nproviding exchange telephone services to any service user in this\n\nstate, and shall include any competitive local exchange carrier as\n\ndefined in Section 139.102 of Title 17 of the Oklahoma Statutes;\n\n8. “Next-generation 9-1-1” or “NG9-1-1” means an:\n\na. IP-based system comprised of hardware, software, data,\n\nand operational policies and procedures that:\n\n(1) provides standardized interfaces from emergency\n\ncall and message services to support emergency\n\ncommunications,\n\n(2) processes all types of emergency calls, including\n\nvoice, text, data and multimedia information,\n\n(3) acquires and integrates additional emergency call\n\ndata useful to call routing and handling,\n\n(4) delivers the emergency calls, messages and data\n\nto the appropriate public safety answering point\n\nand other appropriate emergency entities,\n\n(5) supports data or video communications needs for\n\ncoordinated incident response and management, and\n\n(6) provides broadband service to public safety\n\nanswering points or other first responder\n\nentities, or\n\nb. IP-based system comprised of hardware, software, data\n\nand operational policies and procedures that conforms\n\nwith subsequent amendments made to the definition of\n\nNext Generation 9-1-1 services in Public Law 112-96;\n\n9. “9-1-1 emergency telephone service” means any telephone\n\nsystem whereby telephone subscribers may utilize a three-digit\n\nnumber (9-1-1) for reporting an emergency to the appropriate public\n\nagency providing law enforcement, fire, medical or other emergency\n\nservices, including ancillary communications systems and personnel\n\nnecessary to pass the reported emergency to the appropriate\n\nemergency service and which the wireless service provider is\n\nrequired to provide pursuant to the Federal Communications\n\nCommission Order 94-102 (961 Federal Register 40348);\n\n10. “9-1-1 wireless telephone fee” means the fee imposed in\n\nSection 2865 of this title to finance the installation and operation\n\nof emergency 9-1-1 services and any necessary equipment;\n\n11. “Person” means any service user, including, but not limited\n\nto, any individual, firm, partnership, co-partnership, joint\n\nventure, association, cooperative organization, private corporation,\n\nwhether organized for profit or not, fraternal organization,\n\nnonprofit organization, estate, trust, business or common law trust,\n\nreceiver, assignee for the benefit of creditors, trustee or trustee\nt;\n\n11. “Person” means any service user, including, but not limited\n\nto, any individual, firm, partnership, co-partnership, joint\n\nventure, association, cooperative organization, private corporation,\n\nwhether organized for profit or not, fraternal organization,\n\nnonprofit organization, estate, trust, business or common law trust,\n\nreceiver, assignee for the benefit of creditors, trustee or trustee\n\nin bankruptcy, the United States of America, the state, any\n\npolitical subdivision of the state, or any federal or state agency,\n\ndepartment, commission, board or bureau;\n\n12. “Place of primary use” means the street address\n\nrepresentative of where the use of the mobile telecommunications\n\nservice of the customer primarily occurs, which shall be the\n\nresidential street address or the primary business street address of\n\nthe customer and shall be within the licensed service area of the\n\nhome service provider in accordance with Section 55001 of Title 68\n\nof the Oklahoma Statutes and the federal Mobile Telecommunications\n\nSourcing Act, P.L. No. 106-252, codified at 4 U.S.C. 116-126;\n\n13. “Prepaid wireless telecommunications service” means a\n\ntelecommunications wireless service that provides the right to\n\nutilize mobile wireless service as well as other telecommunications\n\nservices including the download of digital products delivered\n\nelectronically, content and ancillary services, which are paid for\n\nin advance and sold in predetermined units or dollars of which the\n\nnumber declines with use in a known amount;\n\n14. “Proprietary information” means wireless service provider\n\nor VoIP service provider, subscriber, market share, cost and review\n\ninformation;\n\n15. “Public agency” means any city, town, county, municipal\n\ncorporation, public district, public trust, substate planning\n\ndistrict, public authority or tribal authority located within this\n\nstate which provides or has authority to provide firefighting, law\n\nenforcement, ambulance, emergency medical or other emergency\n\nservices;\n\n16. “Public safety answering point” or “PSAP” means an entity\n\nresponsible for receiving 9-1-1 calls and processing those calls\n\naccording to specific operational policy;\n\n17. “Public safety telecommunicator” means a person who\n\nperforms a public service by processing, analyzing, and dispatching\n\ncalls for emergency assistance. The person is a first responder\n\nthat provides pre-arrival instructions and has specialized training\n\nto mitigate the loss of life and property;\n\n18. “Service user” means any person who is provided exchange\n\ntelephone service in this state;\n\n19. “Tariff rate” means the rate or rates billed by a local\n\nexchange telephone company stated in tariffs applicable for such\n\ncompany, as approved by the Oklahoma Corporation Commission, or the\n\ncurrent equivalent of such rates, which represent the recurring\n\ncharges of such local exchange telephone company for exchange\n\ntelephone service or its equivalent, exclusive of all taxes, fees,\n\nlicenses or similar charges whatsoever;\n\n20. “Wireless service provider” means a provider of commercial\n\nmobile service under Section 332(d) of the Telecommunications Act of\n\n1996, 47 U.S.C., Section 151 et seq., Federal Communications\n\nCommission rules, and the Omnibus Budget Reconciliation Act of 1993,\n\nPub. L. No. 103-66, and includes a provider of wireless two-way\n\ncommunication service, radio-telephone communications related to\n\ncellular telephone service, network radio access lines or the\n\nequivalent, and personal communication service. The term does not\n\ninclude a provider of:\n\na. a service whose users do not have access to 9-1-1\n\nservice,\n\nb. a communication channel used only for data\n\ntransmission, or\n\nc. a wireless roaming service or other nonlocal radio\n\naccess line service;\n\n21. “Wireless telecommunications connection” means the ten-\nal communication service. The term does not\n\ninclude a provider of:\n\na. a service whose users do not have access to 9-1-1\n\nservice,\n\nb. a communication channel used only for data\n\ntransmission, or\n\nc. a wireless roaming service or other nonlocal radio\n\naccess line service;\n\n21. “Wireless telecommunications connection” means the ten-\n\ndigit access number assigned to a customer regardless of whether\n\nmore than one such number is aggregated for the purpose of billing a\n\nservice user; and\n\n22. “Voice over Internet Protocol (VoIP) provider” means a\n\nprovider of interconnected Voice over Internet Protocol service to\n\nend users in the state, including resellers.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5f2a80dc6e5d52ff1c95adec65bf06b4e84ac9540bc8b2a26cee6fbd479a17ff","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-2861","next":"us-ok/okla.-stat.-tit.-63-63-2863"},"notice":"GroundRules: Original legal text.
