There shall be imposed a 9-1-1 telephone fee as follows:\n\n1. One Dollar and twenty-five cents ($1.25) monthly on each\n\nwireless telephone connection and other wireless communication\n\ndevice or service connection with the ability to dial 9-1-1 for\n\nemergency calls;\n\n2. One Dollar and twenty-five cents ($1.25) monthly on each\n\nservice with the ability to dial 9-1-1 for emergency calls,\n\nincluding landline; and\n\n3. One Dollar and twenty-five cents ($1.25) on each prepaid\n\nwireless retail transaction occurring in this state.\n\nB. 1. For purposes of paragraph 3 of subsection A of this\n\nsection, a retail transaction that is effected in person by a\n\nconsumer at a business location of the seller shall be treated as\n\noccurring in this state if that business location is in this state.\n\nAny other retail transaction shall be sourced as provided in\n\nparagraphs 2 through 5 of this subsection as applicable.\n\n2. When the retail transaction does not occur at a business\n\nlocation of the seller, the retail transaction shall be sourced to\n\nthe location where receipt by the consumer, or the consumer’s donee,\n\ndesignated as such by the consumer, occurs, including the location\n\nindicated by instructions for delivery to the consumer or donee,\n\nknown to the seller.\n\n3. When the provisions of paragraph 2 of this subsection do not\n\napply, the sale shall be sourced to the location indicated by an\n\naddress for the consumer that is available from the business records\n\nof the seller that are maintained in the ordinary course of the\n\nseller’s business when use of this address does not constitute bad\n\nfaith.\n\n4. When the provisions of paragraphs 2 and 3 of this subsection\n\ndo not apply, the sale shall be sourced to the location indicated by\n\nan address for the consumer obtained during the consummation of the\n\nsale, including the address of a consumer’s payment instrument, if\n\nno other address is available, when use of this address does not\n\nconstitute bad faith.\n\n5. When none of the previous rules of paragraphs 1, 2, 3 and 4\n\nof this subsection apply, including the circumstance in which the\n\nseller is without sufficient information to apply the previous\n\nrules, then the location shall be determined by the address from\n\nwhich the service was provided, disregarding for these purposes any\n\nlocation that merely provided the digital transfer of the product\n\nsold. If the seller knows the mobile telephone number, the location\n\nwill be that which is associated with the mobile telephone number.\n\nC. From each one-dollar-and-twenty-five-cent fee assessed and\n\ncollected pursuant to subsection A of this section, twenty-two cents\n\n($0.22) shall be deposited into the Oklahoma 9-1-1 Management\n\nAuthority Revolving Fund created pursuant to Section 2869 of this\n\ntitle. Funds accumulating in this revolving fund shall be used to\n\nfund the salary of the Oklahoma 9-1-1 Coordinator and any\n\nadministrative staff, operations of the Authority and any costs\n\nassociated with the administration of the Oklahoma 9-1-1 Management\n\nAuthority Act within the Oklahoma Department of Emergency Management\n\nand Homeland Security, and for grants approved by the Authority for\n\npurposes as authorized in the Oklahoma 9-1-1 Management Authority\n\nAct.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"664f3a4f771d46d384785fef77d3d3a3412b7ff64ae84d8df90126ffa4ec174f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-2864","next":"us-ok/okla.-stat.-tit.-63-63-2866"},"notice":"GroundRules: Original legal text.
