Stat. tit. 63, § 63-2902","heading":"Disbursement and implementation of Fund - Publicizing","body":"program - Eligibility standards - Priority of applications -\n\nIssuance of grants - Form of applications - Contractors;\n\neligibility, payments, monitoring and audit of financial and\n\noperating records.\n\nA. The Oklahoma Department of Commerce shall be responsible for\n\nthe disbursement and implementation of the Energy Conservation\n\nAssistance Fund.\n\nB. The Department shall involve senior citizen groups, social\n\nservice agencies and other civic groups in publicizing such program.\n\nC. The Department of Human Services, in cooperation with the\n\nOklahoma Department of Commerce, shall determine eligibility\n\nrequirements necessary to qualify a homeowner to obtain such grants.\n\nUpon meeting any such eligibility standards, the Department of Human\n\nServices shall certify to the Oklahoma Department of Commerce that\n\nsuch homeowner is qualified to receive such grant upon notification\n\nof such certification. The Oklahoma Department of Commerce shall\n\ndistribute the grant funds. Priorities shall be established for\n\napplications according to those indicating the greatest need. Low-\n\nincome elderly and handicapped applicants shall be given first\n\npriority.\n\nD. In order to qualify for grant assistance, the property shall\n\nmeet all of the following requirements:\n\n1. The property shall be the homestead of the applicant; and\n\n2. The property for which the grant is issued shall not be\n\nincome-producing or used in any method other than as the principal\n\nresidence of the applicant.\n\nE. Grants may be issued to finance the following types of\n\nweatherization:\n\n1. Structural repairs necessary to improve efficient heating\n\nand cooling of the residence;\n\n2. Insulation for attics, walls and water heaters;\n\n3. Replacement of broken glass, inefficient doors and door\n\nthresholds;\n\n4. Storm windows;\n\n5. Caulking and weather stripping; and\n\n6. Other appropriate energy conservation measures as determined\n\nby the Oklahoma Department of Commerce.\n\nNo grants shall be made through this program unless an energy\n\naudit has been performed on the applicant's principal residence.\n\nNo grant shall exceed Three Thousand Dollars ($3,000.00). No\n\ngrant shall be awarded to any applicant with an annual income in\n\nexcess of the amount specified in this subsection.\n\nIncome eligibility shall be determined based on one hundred\n\ntwenty-five percent (125%) of the poverty guidelines issued by the\n\nUnited States Office of Management and Budget.\n\nF. The application for the grant shall be in such form as\n\ndetermined by the Oklahoma Department of Commerce. No grant shall\n\nbe issued to any person until such person has been certified as\n\neligible by the Department of Human Services. The applicant shall\n\nbe provided with copies of all documents related to the issuance of\n\nthe grant. The applicant shall provide documents, as required,\n\nconcerning the status of property and household income.\n\nG. 1. The Oklahoma Department of Commerce contractors shall be\n\nnonprofit community action agencies or other nonprofit entities\n\nexperienced with weatherization programs. The Oklahoma Department\n\nof Commerce shall monitor contractors for compliance with all\n\nDepartment policies, guidelines and regulations.\n\n2. Contractors shall be responsible for completion and\n\ninspection of all work undertaken. No payment shall be made to any\n\ncontractor until after the required documentation is submitted and\n\napproved by the Oklahoma Department of Commerce. Payments to\n\ncontractors shall be made for services rendered and shall be based\n\non the costs previously agreed to in writing.\n\nH. The Oklahoma Department of Commerce shall actively monitor\n\nand audit the financial and operating records of the contractors\n\ninvolved with the Energy Conservation Assistance Fund to assure\n\nappropriate compliance with established regulations, guidelines and\n\nstandards. The Oklahoma Department of Commerce shall also monitor\nered and shall be based\n\non the costs previously agreed to in writing.\n\nH. The Oklahoma Department of Commerce shall actively monitor\n\nand audit the financial and operating records of the contractors\n\ninvolved with the Energy Conservation Assistance Fund to assure\n\nappropriate compliance with established regulations, guidelines and\n\nstandards.
