A manufacturer of an investigational drug, biological\n\nproduct or device may make available the manufacturer's\n\ninvestigational drug, biological product or device to eligible\n\npatients pursuant to the Right to Try Act. An investigational drug,\n\nbiological product or device may be made available through a\n\npharmacy. This act does not require that a manufacturer make\n\navailable an investigational drug, biological product or device to\n\nan eligible patient.\n\nB. A manufacturer may:\n\n1. Provide an investigational drug, biological product or\n\ndevice to an eligible patient without receiving compensation; or\n\n2. Require an eligible patient to pay the costs of, or the\n\ncosts associated with, the manufacture of the investigational drug,\n\nbiological product or device.\n\nC. A health insurance carrier may, but is not required to,\n\nprovide coverage for the cost of an investigational drug, biological\n\nproduct or device.\n\nD. An insurer may deny coverage to an eligible patient from the\n\ntime the eligible patient begins use of the investigational drug,\n\nbiological product or device through a period not to exceed six (6)\n\nmonths from the time the investigational drug, biological product or\n\ndevice is no longer used by the eligible patient; provided, that\n\ncoverage may not be denied for a preexisting condition and for\n\ncoverage for benefits which commenced prior to the time the eligible\n\npatient begins use of such drug, biological product or device.\n\nE.
