The purpose of the Oklahoma Advance Directive Act is to:\n\n1. Recognize the right of individuals to control some aspects\n\nof their own medical care and treatment, including but not limited\n\nto the right to decline medical treatment or to direct that it be\n\nwithdrawn, even if death ensues;\n\n2. Recognize that the right of individuals to control some\n\naspects of their own medical treatment is protected by the\n\nConstitution of the United States and overrides any obligation the\n\nphysician and other health care providers may have to render care or\n\nto preserve life and health;\n\n3. Recognize that decisions concerning one's medical treatment\n\ninvolve highly sensitive, personal issues that do not belong in\n\ncourt, even if the individual is incapacitated, so long as a proxy\n\ndecision-maker can make the necessary decisions based on the known\n\nintentions, personal views, or best interests of the individual. If\n\nevidence of the individual's wishes is sufficient, those wishes\n\nshould control; if there is not sufficient evidence of the\n\nindividual's wishes, the proxy's decisions should be based on the\n\nproxy's reasonable judgment about the individual's values and what\n\nthe individual's wishes would be based upon those values. The\n\nproper role of the court is to settle disputes and to act as the\n\nproxy decision-maker of last resort when no other proxy is\n\nauthorized by the individual or is otherwise authorized by law;\n\n4. Restate and clarify the law to ensure that the individual's\n\nadvance directive for health care will continue to be honored during\n\nincapacity without court involvement; and\n\n5. Encourage and support health care instructions by the\n\nindividual in advance of incapacity and the delegation of decision-\n\nmaking powers to a health care proxy.\n\nB. To be sure that the individual's health care instructions\n\nand proxy decision-making will be effective, the Oklahoma Advance\n\nDirective Act also includes necessary and appropriate protection for\n\nproxies and health care providers who rely in good faith on the\n\ninstructions of the individual and the decisions of an authorized\n\nproxy.\n\nC.
