Stat. tit. 63, § 63-3101.3","heading":"Definitions","body":"As used in the Oklahoma Advance Directive Act:\n\n1. \"Advance directive for health care\" means any writing\n\nexecuted in accordance with the requirements of Section 3101.4 of\n\nthis title and may include a living will, the appointment of a\n\nhealth care proxy, or both such living will and appointment of a\n\nproxy;\n\n2. \"Attending physician\" means the physician who has primary\n\nresponsibility for the treatment and care of the patient;\n\n3. \"Declarant\" means any individual who has issued an advance\n\ndirective according to the procedure provided for in Section 3101.4\n\nof this title;\n\n4. “End-stage condition” means a condition caused by injury,\n\ndisease, or illness, which results in severe and permanent\n\ndeterioration indicated by incompetency and complete physical\n\ndependency for which, to a reasonable degree of medical certainty,\n\ntreatment of the irreversible condition would be medically\n\nineffective;\n\n5. \"Health care provider\" means a person who is licensed,\n\ncertified, or otherwise authorized by the law of this state to\n\nadminister health care in the ordinary course of business or\n\npractice of a profession;\n\n6. \"Health care proxy\" is an individual eighteen (18) years old\n\nor older appointed by the declarant as attorney-in-fact to make\n\nhealth care decisions including, but not limited to, the provision,\n\nwithholding, or withdrawal of life-sustaining treatment if a\n\nqualified patient, in the opinion of the attending physician and\n\nanother physician, is persistently unconscious, incompetent, or\n\notherwise mentally or physically incapable of communication;\n\n7. \"Persistently unconscious\" means an irreversible condition,\n\nas determined by the attending physician and another physician, in\n\nwhich thought and awareness of self and environment are absent;\n\n8. \"Person\" means an individual, corporation, business trust,\n\nestate, trust, partnership, association, joint venture, government,\n\ngovernmental subdivision or agency, or any other legal or commercial\n\nentity;\n\n9. \"Physician\" means an individual licensed to practice\n\nmedicine in this state;\n\n10. \"Qualified patient\" means a patient eighteen (18) years of\n\nage or older who has executed an advance directive and who has been\n\ndetermined to be incapable of making an informed decision regarding\n\nhealth care, including the provision, withholding, or withdrawal of\n\nlife-sustaining treatment, by the attending physician and another\n\nphysician who have examined the patient;\n\n11. \"State\" means a state, territory, or possession of the\n\nUnited States, the District of Columbia, or the Commonwealth of\n\nPuerto Rico; and\n\n12. \"Terminal condition\" means an incurable and irreversible\n\ncondition that, even with the administration of life-sustaining\n\ntreatment, will, in the opinion of the attending physician and\n\nanother physician, result in death within six (6) months.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c9ac9ecc90aa4bd2e1fe89941f0d72d2d069c3214838fc71d62c0971f6db71dd","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-3101.2","next":"us-ok/okla.-stat.-tit.-63-63-3101.4"},"notice":"GroundRules: Original legal text.
