Stat. tit. 63, § 63-3111.2","heading":"Definitions","body":"As used in the Oklahoma Health Care Agent Act:\n\n1. \"Advance directive for health care\" means any writing\n\nexecuted in accordance with the requirements of Section 3101.4 of\n\nTitle 63 of the Oklahoma Statutes;\n\n2. \"Agent\" means an individual designated in a power of\n\nattorney for health care to make a health care decision for the\n\nindividual granting the power;\n\n3. \"Attending physician\" means the physician who has primary\n\nresponsibility for the treatment and care of a patient;\n\n4. \"Capacity\" means an individual's ability to understand and\n\nappreciate the nature and implications of a health care decision, to\n\nmake an informed choice regarding the alternatives presented\n\nincluding understanding and appreciating the significant benefits\n\nand risks, and to make and communicate a health care decision in an\n\nunambiguous manner;\n\n5. \"Health care\" means any care, treatment, service, or\n\nprocedure to maintain, diagnose, or otherwise affect an individual's\n\nphysical or mental condition;\n\n6. \"Health care decision\" means a decision made by an\n\nindividual or the individual's agent regarding the individual's\n\nhealth care including:\n\na. selection and discharge of health care providers and\n\nfacilities,\n\nb. consent to or refusal of any care, treatment, service,\n\nor procedure to maintain, diagnose, or otherwise\n\naffect a physical or mental condition, and\n\nc. signing a do-not-resuscitate consent in accordance\n\nwith the provisions of the Oklahoma Do-Not-Resuscitate\n\nAct, Section 3131.1 et seq. of Title 63 of the\n\nOklahoma Statutes.\n\nHealth care decision shall not include the ability of the agent to\n\nmake decisions about the withholding or withdrawal of nutrition or\n\nhydration;\n\n7. \"Health care facility\" means any public or private\n\norganization, corporation, authority, partnership, sole\n\nproprietorship, association, agency, network, joint venture, or\n\nother entity that is established and appropriately licensed in this\n\nstate to administer or provide health care services. Health care\n\nfacility includes but is not limited to hospitals, medical centers,\n\nambulatory surgery centers, physicians' offices, clinics, nursing\n\nhomes, rehabilitation centers, home care agencies, hospices, and\n\nlong-term care agencies;\n\n8. \"Health care provider\" means a person who is licensed,\n\ncertified, or otherwise authorized by the laws of this state to\n\nadminister health care in the ordinary course of business or\n\npractice of a profession;\n\n9. \"Individual instruction\" means an individual's direction\n\nconcerning a health care decision for the individual;\n\n10. \"Person\" means a person eighteen (18) years of age or older\n\nor a minor who may consent to have services provided by health\n\nprofessionals pursuant to Section 2602 of Title 63 of the Oklahoma\n\nStatutes;\n\n11. \"Physician\" means an individual authorized to practice\n\nmedicine or osteopathy pursuant to Chapter 11 or Chapter 14 of Title\n\n59 of the Oklahoma Statutes;\n\n12. \"Power of attorney for health care\" means the designation\n\nof an agent to make health care decisions for the individual\n\ngranting the power;\n\n13. \"Reasonably available\" means readily able to be contacted\n\nwithout undue effort and willing and able to act in a timely manner\n\nconsidering the urgency of the patient's health care needs; and\n\n14. \"State\" means a state of the United States, the District of\n\nColumbia, the Commonwealth of Puerto Rico, or a territory or insular\n\npossession subject to the jurisdiction of the United States.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"232c9c291adeafe86f9e469707b2db27bbac24d00423f74b8eceeaeddc36e415","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-3111.13","next":"us-ok/okla.-stat.-tit.-63-63-3111.3"},"notice":"GroundRules: Original legal text.
