Before implementing a health care decision made for a\n\npatient, the attending physician, if possible, shall promptly\n\ncommunicate to the patient the decision made and the identity of the\n\nperson making the decision.\n\nB. An attending physician who knows of the existence of a power\n\nof attorney for health care or a revocation of a power of attorney\n\nfor health care shall promptly record its existence in the patient's\n\nmedical record and, if it is in writing, shall request a copy and if\n\none is furnished shall arrange for its maintenance in the medical\n\nrecord. An attending physician who makes or is informed of a\n\ndetermination that a patient lacks or has recovered capacity shall\n\npromptly record the determination in the patient's medical record\n\nand communicate the determination to the patient, if possible, and\n\nto any person then authorized to make health care decisions for the\n\npatient.\n\nC. Except as provided in subsections D and E of this section, a\n\nhealth care provider or facility providing care to a patient shall:\n\n1. Comply with an individual instruction of the patient and\n\nwith a reasonable interpretation of that instruction made by a\n\nperson then authorized to make health care decisions for the\n\npatient; and\n\n2. Comply with a health care decision for the patient made by a\n\nperson then authorized to make health care decisions for the patient\n\nto the same extent as if the decision had been made by the patient\n\nwhile having capacity.\n\nD. An attending physician or health care provider may decline\n\nto comply with an individual instruction or health care decision for\n\nreasons of conscience. A health care facility may decline to comply\n\nwith an individual instruction or health care decision if the\n\ninstruction or decision is contrary to a policy of the facility\n\nwhich is expressly based on reasons of conscience and if the policy\n\nwas timely communicated to the patient or to a person then\n\nauthorized to make health care decisions for the patient.\n\nE. A health care provider or facility may decline to comply\n\nwith an individual instruction or health care decision that requires\n\nmedically ineffective or non-beneficial health care or health care\n\ncontrary to generally accepted health care standards applicable to\n\nthe health care provider or facility.\n\nF. A health care provider or facility that declines to comply\n\nwith an individual instruction or health care decision shall:\n\n1. Promptly so inform the patient, if possible, and any person\n\nthen authorized to make health care decisions for the patient;\n\n2. Provide continuing care to the patient until a transfer can\n\nbe effected; and\n\n3. Unless the patient or person then authorized to make health\n\ncare decisions for the patient refuses assistance, immediately make\n\nall reasonable efforts to assist in the transfer of the patient to\n\nanother health care provider or facility that is willing to comply\n\nwith the instruction or decision.\n\nG. A health care provider or facility may not require or\n\nprohibit the execution or revocation of an advance health care\n\ndirective as a condition for providing health care.\n\nH.
