This section shall be known and may be cited as “Lily’s\n\nLaw”.\n\nB. As used in this section:\n\n1. “Birthing center” has the same meaning as provided by\n\nSection 1-701 of this title;\n\n2. “Fetal death” means:\n\na. spontaneous death prior to the complete expulsion or\n\nextraction from its mother of an unborn child,\n\nirrespective of gestational age. The death is\n\nindicated by the fact that, after such expulsion or\n\nextraction, the unborn child does not breathe or show\n\nany other evidence of life such as beating of the\n\nheart, pulsation of the umbilical cord or definite\n\nmovement of voluntary muscles,\n\nb. death that occurs as the result of accidental trauma\n\nor a criminal assault on the pregnant female or her\n\nunborn child, irrespective of gestational age, or\n\nc. death that occurs, irrespective of gestational age,\n\nfrom the use or prescription of any instrument,\n\nmedicine, drug or any other substance or device to\n\nremove an ectopic pregnancy; and\n\n3. “Stillbirth” shall have the same meaning as provided by\n\nsubparagraph a of paragraph 1 of this subsection.\n\nC. Every licensed hospital, birthing center, or licensed\n\nmedical facility in this state shall maintain a written policy for\n\nthe disposition of the remains of a child from a stillbirth or fetal\n\ndeath event at such hospital, birthing center or medical facility.\n\nA parent of the child shall have the right to direct the disposition\n\nof the remains, except that disposition may be made by the hospital,\n\nbirthing center or medical facility if no direction is given by a\n\nparent within fourteen (14) days following the delivery of the\n\nremains. The policy and the disposition shall comply with all\n\napplicable provisions of state and federal law. Upon the delivery\n\nof a child from a stillbirth or a fetal death event, the hospital,\n\nbirthing center or medical facility shall notify at least one (1)\n\nparent of the parents’ right to direct the disposition of the\n\nremains of the child and shall provide at least (1) one parent with\n\na copy of its policy with respect to disposition.\n\nD. Except as otherwise provided by law, nothing in this section\n\nshall be interpreted to prohibit any hospital, birthing center or\n\nmedical facility from providing additional notification and\n\nassistance to the parent of a child delivered as a stillbirth or a\n\nfetal death event at the hospital, birthing center or medical\n\nfacility relating to the disposition of the remains of the child.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8c8d5828dfe582a0df36533dbfaa2a93762beae7fac4c61a24b86e8a07138dde","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-3123","next":"us-ok/okla.-stat.-tit.-63-63-3131.1"},"notice":"GroundRules: Original legal text.
