Stat. tit. 63, § 63-3162","heading":"Brochure and online presentation of rights and","body":"responsibilities for health care providers – Certification\n\nrequirements.\n\nA. The State Board of Medical Licensure and Supervision shall\n\nprepare, and from time to time amend, a brochure to inform health\n\ncare providers of their responsibilities and rights under the\n\nspecified sections of the Hydration and Nutrition for Incompetent\n\nPatients Act (Sections 3080.2 through 3080.5 of this title), the\n\nNondiscrimination in Treatment Act (Sections 3090.2 and 3090.3 of\n\nthis title), the Oklahoma Advance Directive Act (Section 3101.9 of\n\nthis title), the Oklahoma Do-Not-Resuscitate Act (Section 3131.4 of\n\nthis title) and the Assisted Suicide Prevention Act (Sections 3141.3\n\nand 3141.4 of this title). The brochure shall include contact\n\ninformation for officials to whom alleged violations of those\n\nprovisions may be reported. The Board shall prepare, from time to\n\ntime revise, and make available on the Board's website an online\n\npresentation, which shall be a minimum of one (1) hour in length,\n\nconsisting of training on the responsibilities and rights of health\n\ncare providers covered by the current brochure. The Board shall\n\nprovide for means to verify that a viewer indeed observed the full\n\nonline presentation, such as a quiz on its content to be answered at\n\nthe end of the presentation or other methods commonly employed in\n\nassociation with continuing medical education. The Board shall\n\nprovide to each viewer who complies with such verification a dated\n\ncertification that the viewer completed the online training. The\n\nBoard shall make the current brochure and online presentation\n\navailable on the Board's website and shall inform all Oklahoma\n\ninpatient health care services entities of their availability and\n\nhow to access them online on the Board's website.\n\nB. Inpatient health care services entities shall ensure that\n\nall health care providers and other defined officials associated\n\nwith the inpatient health care services entity are provided with a\n\ncopy of the current brochure and sign a certification that they have\n\nread the brochure and are familiar with their responsibilities and\n\nrights as set forth therein:\n\n1. Within fourteen (14) days of beginning employment with, of\n\nbeginning service on the board of directors of, or of beginning to\n\nprovide services to patients at the entity; and\n\n2. At least once during each calendar year.\n\nC. At least once during each consecutive two-calendar-year\n\nperiod all health care providers and the administrator or chief\n\nexecutive officer, by whatever title the person serving that\n\nfunction may be called, associated with an inpatient health care\n\nservices entity shall observe the online presentation described in\n\nsubsection A of this section. The time required for observation of\n\nthis presentation shall count as part of, rather than being in\n\naddition to, continuing education otherwise required for licensed\n\nhealth care providers. Inpatient health care services entities\n\nshall ensure that all health care providers and other defined\n\nofficials associated with the inpatient health care services entity\n\nprovide the entity with a copy of each dated certification by the\n\nBoard verifying that the provider or official observed the online\n\npresentation described in subsection A of this section in compliance\n\nwith this requirement, and shall maintain such copies on file for a\n\nminimum of four (4) calendar years following the calendar year to\n\nwhich they apply. The files of such copies shall be subject to\n\ninspection under subsection B of Section 1-705, and Sections 1-829\n\nand 1-1911 of this title.\n\nD. The provisions of subsection B of this section shall be\n\neffective at the beginning of the second calendar month after the\n\nmonth in which the State Board of Medical Licensure and Supervision\n\npublishes the initial brochure required by this section on its\nTitle 63. Public Health and Safety Page 1514\n\ninspection under subsection B of Section 1-705, and Sections 1-829\n\nand 1-1911 of this title.\n\nD. The provisions of subsection B of this section shall be\n\neffective at the beginning of the second calendar month after the\n\nmonth in which the State Board of Medical Licensure and Supervision\n\npublishes the initial brochure required by this section on its\n\nwebsite. The provisions of subsection C of this section shall be\n\neffective beginning with calendar year 2015.\n\nE.
