Stat. tit. 63, § 63-3242.2","heading":"Definitions","body":"As used in the Ambulance Service Provider Access Payment Program\n\nAct:\n\n1. \"Air ambulance\" means ambulance services provided by fixed\n\nor rotor wing ambulance services;\n\n2. \"Alliance\" means the Oklahoma Ambulance Alliance or its\n\nsuccessor association;\n\n3. \"Ambulance\" means a motor vehicle that is primarily used or\n\ndesignated as available to provide transportation and basic life\n\nsupport or advanced life support;\n\n4. \"Ambulance service\" or \"ambulance service provider\" means\n\nany private firm or governmental agency which is or should be\n\nlicensed by the State Department of Health to provide levels of\n\nmedical care based on certification rules or standards promulgated\n\nby the State Commissioner of Health;\n\n5. \"Department\" means the State Department of Health;\n\n6. \"Emergency\" or \"emergent\" means a serious situation or\n\noccurrence that happens unexpectedly and demands immediate action,\n\nsuch as a medical condition manifesting itself by acute symptoms of\n\nsufficient severity including severe pain such that the absence of\n\nimmediate medical attention could reasonably be expected, by a\n\nreasonable and prudent layperson, to result in placing the patient’s\n\nhealth in serious jeopardy, serious impairment to bodily function or\n\nserious dysfunction of any bodily organ or part;\n\n7. \"Emergency transport\" means the movement of an acutely ill\n\nor injured patient from the scene to a health care facility or the\n\nmovement of an acutely ill or injured patient from one health care\n\nfacility to another health care facility;\n\n8. \"Licensure\" means the licensing of emergency ambulance\n\nservices pursuant to rules and standards promulgated by the State\n\nCommissioner of Health;\n\n9. \"Net operating revenue\" means the gross revenues earned for\n\nproviding emergency and nonemergency transports in Oklahoma\n\nexcluding revenues earned for providing air ambulance services and\n\namounts refunded to or recouped, offset or otherwise deducted by a\n\npatient or payer for ground medical transportation;\n\n10. \"Nonemergency transport\" means the movement of any patient\n\nin an ambulance other than an emergency transport;\n\n11. \"Upper payment limit\" means the lesser of the customary\n\ncharges of the ambulance service provider or the prevailing charges\n\nin the locality of the ambulance service provider for comparable\n\nservices under comparable circumstances, calculated according to\n\nmethodology in an approved state plan amendment for the state\n\nMedicaid program; and\n\n12. \"Upper payment limit gap\" means the difference between the\n\nupper payment limit of the ambulance service provider and the\n\nMedicaid payments not financed using the ambulance service provider\n\nassessments made to all ambulance service providers, provided that\n\nthe upper payment limit gap shall not include air ambulance\n\nservices.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1517397fc98fd8ef80d59b6609a27796849571ef60e158afb79daeaae249d520","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-3242.1","next":"us-ok/okla.-stat.-tit.-63-63-3242.3"},"notice":"GroundRules: Original legal text.
