Stat. tit. 63, § 63-3292","heading":"Leases from Oklahoma State University Medical Authority","body":"to Oklahoma State University Medical Trust - Transfers of title -\n\nOther agreements.\n\nA. Contingent upon the creation of the Oklahoma State\n\nUniversity Medical Trust as provided in Section 20 of this act, the\n\nOklahoma State University Medical Authority is hereby authorized to\n\nlease, for a term of not more than fifty (50) years, renewable at\n\nthe option of the Authority, all real property owned by the\n\nAuthority and any other sites under the control of the Authority to\n\nthe Oklahoma State University Medical Trust. Any lease agreement\n\nmade pursuant to this section shall be contingent upon:\n\n1. Prior review by the Attorney General of any contractual\n\nagreement between the Oklahoma State University Medical Trust and\n\nany entity authorized to transact business in the State of Oklahoma\n\nregarding the lease and operations. The Attorney General shall\n\ndisapprove the agreement if it is determined that provisions of the\n\nagreement are not consistent with state law; and\n\n2. The execution of an operating and lease agreement between\n\nthe Oklahoma State University Medical Trust and any entity\n\nauthorized to transact business in the State of Oklahoma.\n\nB. Concurrent with the execution of a lease of real property\n\nfrom the Oklahoma State University Medical Authority to the Oklahoma\n\nState University Medical Trust as provided in subsection A of this\n\nsection, the Authority is authorized to transfer title to and\n\npossession of all tangible and intangible personal property under\n\nits control to the Trust. In any contractual agreement regarding\n\nthe lease and operations of a hospital or hospitals between the\n\nOklahoma State University Medical Trust and any entity authorized to\n\ntransact business in the State of Oklahoma, the Trust is authorized\n\nto sell or otherwise convey to such entity all tangible and\n\nintangible personal property the Trust may receive from the Oklahoma\n\nState University Medical Authority. Any contract or other agreement\n\nwhich purports to exercise the powers authorized by this subsection\n\nis subject to review by the Contingency Review Board, as specified\n\nin Section 21 of this act.\n\nC. If a contracting entity fails to take possession of the\n\nleased premises, or abandons or surrenders possession of the leased\n\npremises other than to a state agency, at any time during the term\n\nof the lease between the Oklahoma State University Medical Trust and\n\nthe contracting entity, the interest in the real property leased to\n\nthe Oklahoma State University Medical Trust by the Oklahoma State\n\nUniversity Medical Authority shall revert to and be the sole and\n\nexclusive property of the Oklahoma State University Medical\n\nAuthority.\n\nD. Contingent upon the execution of an agreement between the\n\nOklahoma State University Medical Trust and any entity authorized to\n\ntransact business in the State of Oklahoma, as specified in\n\nsubsection A of this section, the Oklahoma State University Medical\n\nAuthority is authorized to enter into an agreement for such entity\n\nto provide patient care services and perform other related duties\n\nimposed upon the Oklahoma State University Medical Authority by law.\n\nSuch an agreement between the Oklahoma State University Medical\n\nAuthority and such entity is exempt from the requirements of the\n\nOklahoma Central Purchasing Act and any rules adopted by the\n\nOklahoma State University Medical Authority pursuant to the\n\nAdministrative Procedures Act. The governing committee created by\n\nthe agreement and the Oklahoma State University Medical Trust shall\n\nbe subject to the Open Meeting Act and the Open Records Act to the\n\nsame extent and with the same exceptions as provided to for the\n\nOklahoma State University Medical Authority in Section 5 of this act\n\nand shall be exempt from the Oklahoma Central Purchasing Act.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"71f17a43d15061be9732e323ff3355178a10393c11385270c807b6b343e24141","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-3291","next":"us-ok/okla.-stat.-tit.-63-63-3293"},"notice":"GroundRules: Original legal text.
