There is hereby created until February 6, 2006, a Joint\n\nLegislative Commission to Study and Evaluate the Operations of the\n\nOklahoma State University Center for Health Sciences and the\n\nIndigent Health Care System in the Tulsa Metropolitan Service Area.\n\nThe Commission shall be composed of nine (9) members as follows:\n\n1. Three members from the House of Representatives, to be\n\nappointed by the Speaker of the House of Representatives;\n\n2. Three members from the Senate, to be appointed by the\n\nPresident Pro Tempore of the Senate; and\n\n3. Three members from the Office of the Governor, to be\n\nappointed by the Governor.\n\nB. The co-chairpersons of the Commission shall be appointed by\n\nthe Speaker of the House of Representatives and the President Pro\n\nTempore of the Senate. Five members shall constitute a quorum. A\n\nquorum shall be present to conduct official business of the\n\nCommission. Vacancies on the Commission shall be filled by the\n\nauthority where such vacancies exist. The Commission shall commence\n\nwork not later than July 15, 2005.\n\nC. Supportive services shall be provided by the staff of the\n\nOklahoma House of Representatives and the State Senate. The\n\nCommission shall also have the authority to hire such consultants or\n\nauditors as deemed necessary to accomplish the duties and\n\nresponsibilities of the Commission. The expense of hiring any\n\nconsultants or auditors shall be paid by the Oklahoma State\n\nUniversity Center for Health Sciences and/or private or foundation\n\nfunds.\n\nD. The duties and responsibilities of the Commission shall\n\ninclude, but not be limited to:\n\n1. Study, evaluate and investigate the management and\n\noperations of the Oklahoma State University Center for Health\n\nSciences, including any relationships currently existing or proposed\n\nwith hospitals in the Tulsa Metropolitan Service Area;\n\n2. Evaluate the mission and ability of the Oklahoma State\n\nUniversity Center for Health Sciences in providing medical teaching\n\nand residency programs to prepare doctors for placement in rural\n\nOklahoma communities;\n\n3. Investigate potential options for providing a stable\n\nteaching hospital environment for the continuation of residency\n\nprograms for the Oklahoma State University Center for Health\n\nSciences;\n\n4. Audit and study all financial arrangements or proposed\n\nfinancial agreements related to maintaining the highest quality\n\nmedical teaching and residency program possible for the Oklahoma\n\nState University Center for Health Sciences; and\n\n5. Study, make recommendations, and submit a written report to\n\nthe Legislature and the Governor by December 15, 2005, regarding the\n\nOklahoma State University Center for Health Sciences and the future\n\nof the delivery and efficiency of teaching, residency, and medical\n\nservices across rural Oklahoma and the delivery of care to the\n\nindigent, underserved, and nonindigent populations of the Tulsa\n\nMetropolitan Service Area. The report shall include, at a minimum,\n\nrecommendations for appropriate written agreements for the lease and\n\nmanagement of facilities, provision of indigent care, and\n\nrecommended minimum levels of state appropriations required for the\n\nachievement of a long-term solution for graduate medical education\n\nat the Oklahoma State University Center for Health Sciences.\n\nE. In performing its duties and responsibilities, the\n\nCommission may hold public hearings in various geographical\n\nlocations of the state and may invite individuals and organizations\n\nto make presentations to the Commission. The Commission is further\n\ngranted the authority to administer oaths, subpoena witnesses and\n\nrecords, and to hear evidence.\n\nF. Travel reimbursement shall be the responsibility of the\norming its duties and responsibilities, the\n\nCommission may hold public hearings in various geographical\n\nlocations of the state and may invite individuals and organizations\n\nto make presentations to the Commission. The Commission is further\n\ngranted the authority to administer oaths, subpoena witnesses and\n\nrecords, and to hear evidence.\n\nF. Travel reimbursement shall be the responsibility of the\n\nappointing authority and shall be subject to the State Travel\n\nReimbursement Act. Legislative members to the Commission shall be\n\nreimbursed pursuant to the provisions of Section 456 of Title 74 of\n\nthe Oklahoma Statutes.\n\nG. The Commission shall not be subject to the provisions of the\n\nOklahoma Open Records Act with respect to any proprietary\n\ninformation, financial information related to a private for-profit\n\nbusiness entity or a nonprofit organization, or other information\n\nthat would place a business entity or nonprofit organization at a\n\ncompetitive disadvantage or that the entity would not disclose to a\n\nthird party without the requirement of judicial process.
