Stat. tit. 63, § 63-4009.1","heading":"Serial numbers for outboard motors – Rules - Penalties","body":"A. 1. Service Oklahoma shall promulgate rules specifying the\n\nlocation and manner in which serial numbers for outboard motors\n\nshall be affixed. In promulgating such rules, Service Oklahoma\n\nshall consider the existence of voluntary industry standards, the\n\ncurrent state of technology and the overall process of reducing\n\nvessel and motor thefts in this state.\n\n2. Any outboard motor manufactured on or after October 1, 1985,\n\nwhich is for sale in this state shall comply with the rules\n\npromulgated pursuant to this section.\n\n3. Any person, firm or corporation which sells or offers to\n\nsell any outboard motor or outboard motor part manufactured on or\n\nafter October 1, 1985, which does not comply with this subsection\n\nshall be, upon conviction, guilty of a misdemeanor, punishable by a\n\nfine of up to Five Hundred Dollars ($500.00), imprisonment in the\n\ncounty jail for a period of up to one (1) year, or both such fine\n\nand imprisonment.\n\nB. 1. It is unlawful for any person to knowingly possess any\n\noutboard motor or outboard motor part upon which the serial number\n\nrequired by subsection A of this section has been removed, erased,\n\ndefaced or otherwise altered to prevent identification.\n\n2. It is unlawful for any person to knowingly possess,\n\nmanufacture, sell or exchange, offer to sell or exchange, aid in\n\nsale or exchange, supply in blank, authorize or direct, give away,\n\nor to conspire to or attempt to commit any of the previously\n\nmentioned acts, any counterfeit manufacturer's outboard motor or\n\noutboard motor part serial number plate or decal, used for the\n\npurpose of identification of any outboard motor or outboard motor\n\npart, or to conspire or attempt to commit any of these acts.\n\n3. Any person violating any provision of this subsection shall\n\nbe, upon conviction, guilty of a Class D3 felony offense and shall\n\nbe punished by imprisonment as provided for in subsections B through\n\nF of Section 20P of Title 21 of the Oklahoma Statutes.\n\nC. If any serial number required by this section to identify\n\nownership of an outboard motor or outboard motor part does not exist\n\nor has been removed, erased, defaced or otherwise altered to prevent\n\nidentification, and the true identity cannot be determined, the\n\noutboard motor or outboard motor part may be seized by any peace\n\nofficer in this state and shall be subject to forfeiture pursuant to\n\nthe procedures established for the law enforcement agency by which\n\nthe seizing officer is employed. Such outboard motor or outboard\n\nmotor part may not be sold or used to propel a vessel on the waters\n\nof this state unless and until Service Oklahoma issues to the\n\noutboard motor or outboard motor part a replacement identifying\n\nnumber which shall be affixed to the motor or part and shall\n\nthereafter be used for identification purposes of the motor or part.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1a1e0993b1d97a532d04973cbf1ac85c98f56756bbe5eb3a37e256d215979b41","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-4009","next":"us-ok/okla.-stat.-tit.-63-63-4012"},"notice":"GroundRules: Original legal text.
