Stat. tit. 63, § 63-4041","heading":"Violations - Denial, revocation or suspension of license","body":"- Fine.\n\nService Oklahoma may deny an application for a license, or\n\nrevoke or suspend a license or impose a fine not to exceed Five\n\nHundred Dollars ($500.00) against a dealer for each day that any\n\nprovision of this section or Sections 4033 through 4040 of this\n\ntitle is violated or for any of the following reasons:\n\n1. On satisfactory proof of unfitness of the applicant in any\n\napplication for any license pursuant to the provisions of the\n\nOklahoma Vessel and Motor Registration Act;\n\n2. For any material misstatement made by an applicant in any\n\napplication for any license pursuant to the provisions of the\n\nOklahoma Vessel and Motor Registration Act;\n\n3. For any failure to comply with any provision of the Oklahoma\n\nVessel and Motor Registration Act or any rule promulgated by Service\n\nOklahoma under authority vested in it by the Oklahoma Vessel and\n\nMotor Registration Act, Section 4002 et seq. of this title;\n\n4. A change of condition after license is granted resulting in\n\nfailure to maintain the qualifications for license;\n\n5. Being a dealer who:\n\na. has required a purchaser of a new vessel or motor, as\n\na condition of sale and delivery thereof, to also\n\npurchase special features, appliances, accessories or\n\nequipment not desired or requested by the purchaser\n\nand installed by the dealer,\n\nb. uses any false or misleading advertising in connection\n\nwith his business as such a dealer,\n\nc. has committed any unlawful act which resulted in the\n\nrevocation of any similar license in another state,\n\nd. has failed or refused to perform any written agreement\n\nwith any retail buyer involving the sale of a vessel\n\nor motor,\n\ne. has been convicted of a crime involving moral\n\nturpitude,\n\nf. has committed a fraudulent act in selling, purchasing,\n\nor otherwise dealing in vessels or motors or has\n\nmisrepresented the terms and conditions of a sale,\n\npurchase, or contract for sale or purchase of a vessel\n\nor motor or any interest therein including an option\n\nto purchase such vessel or motor, or\n\ng. has failed to meet or maintain the conditions and\n\nrequirements necessary to qualify for the issuance of\n\na license;\n\n6. Being a dealer who does not have an established place of\n\nbusiness;\n\n7. Being a new vessel or new motor dealer who:\n\na. does not provide for a suitable repair shop separate\n\nfrom the display room with ample space to repair or\n\nrecondition one or more vessels or motors at the same\n\ntime, and which is equipped with such parts, tools and\n\nequipment as may be requisite for the servicing of\n\nvessels or motors in such a manner as to make them\n\ncomply with the safety laws of this state and to\n\nproperly fulfill the dealer's or manufacturer's\n\nwarranty obligation. Provided that the provisions of\n\nthis subparagraph shall not apply to:\n\n(1) mercantile establishments engaged in the selling\n\nof vessels and motors if:\n\n(a) such vessel and motor business does not\n\nconstitute more than ten percent (10%) of\n\nthe business of such establishment,\n\n(b) the vessels sold at such establishment are\n\nunder fourteen (14) feet in length, and\nnufacturer's\n\nwarranty obligation. Provided that the provisions of\n\nthis subparagraph shall not apply to:\n\n(1) mercantile establishments engaged in the selling\n\nof vessels and motors if:\n\n(a) such vessel and motor business does not\n\nconstitute more than ten percent (10%) of\n\nthe business of such establishment,\n\n(b) the vessels sold at such establishment are\n\nunder fourteen (14) feet in length, and\n\n(c) the outboard motors sold at such\n\nestablishment are under ten (10) horsepower,\n\nor\n\n(2) dealers which are engaged solely in the business\n\nof selling canoes. For the purposes of this\n\nsubsection, \"canoe\" shall mean a vessel that is\n\nlong relative to its width, that has curved sides\n\nand is tapered to two (2) pointed ends, or is\n\ntapered to one (1) pointed end and blunt on the\n\nother end, and is generally of traditional shape,\n\nb. does not hold a dealer agreement in effect with a\n\nmanufacturer or distributor of new vessels or motors\n\nfor the sale of the same and is not authorized by the\n\nmanufacturer or distributor to render predelivery\n\npreparation of such vessels or motors sold to\n\npurchasers and to perform any authorized post-sale\n\nwork pursuant to the manufacturer's or distributor's\n\nwarranty, or\n\nc. does not properly service a new vessel or motor before\n\ndelivery of same to the original purchaser thereof.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9c84891d41620787311d545ae3c20942112f244b16bea984bf8e051a601a3c52","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-4040","next":"us-ok/okla.-stat.-tit.-63-63-4042"},"notice":"GroundRules: Original legal text.
