This section shall be known and may be cited as \"Andy's\n\nLaw\".\n\nB. Every vessel in all weathers between the hours from sunset\n\nto sunrise and during periods of restricted visibility shall carry\n\nand exhibit the lights prescribed by the United States Coast Guard\n\nwhen under way, including, but not limited to, the following:\n\n1. Every power-driven vessel shall carry and exhibit:\n\na. a masthead light forward. A vessel less than twenty\n\n(20) meters, or less than sixty-five (65) feet seven\n\nand one-half (7 1/2) inches in length need not exhibit\n\nthis light forward of amidships but shall exhibit it\n\nas far forward as practicable, and\n\nb. side lights, and\n\nc. a stern light;\n\n2. Any power-driven vessel of less than twelve (12) meters, or\n\nless than thirty-nine (39) feet four and one-half (4 1/2) inches in\n\nlength may carry and exhibit, in lieu of the lights prescribed in\n\nparagraph 1 of this subsection, an all-around white light and side\n\nlights;\n\n3. Every sailing vessel shall carry and exhibit:\n\na. side lights, and\n\nb. a stern light;\n\n4. Any sailing vessel of less than twenty (20) meters, or less\n\nthan sixty-five (65) feet seven and one-half (7 1/2) inches, in\n\nlength may combine the lights prescribed in paragraph 3 of this\n\nsubsection within one lantern carried at or near the top of the mast\n\nwhere it can be seen as nearly all-around as possible;\n\n5. Any sailing vessel may carry and exhibit, in addition to the\n\nlights prescribed in paragraph 3 of this subsection but not in\n\nconjunction with any combination lantern as provided in paragraph 4\n\nof this subsection, two all-around lights in a vertical line, the\n\nupper being red and the lower being green, at or near the top of the\n\nmast where they can be seen as nearly all-around as possible;\n\n6. Every sailing vessel of less than seven (7) meters, or less\n\nthan twenty-three (23) feet eleven and one-half (11 1/2) inches in\n\nlength shall carry and exhibit if practicable, the lights prescribed\n\nin paragraph 3 or 4 of this subsection. If such exhibition is not\n\npracticable, there shall be carried ready at hand on the vessel a\n\nlantern or flashlight showing a white light which shall be exhibited\n\nin sufficient time to avert collision;\n\n7. Every sailing vessel propelled by a combination of sail and\n\nmotor shall carry and exhibit the lights of a power-driven vessel\n\nprescribed in paragraph 1 or 2 of this subsection;\n\n8. Every manually powered vessel may carry and exhibit the\n\nlights prescribed in this subsection for sailing vessels. If such\n\nlights are not carried and exhibited, there shall be carried ready\n\nat hand on the vessel a lantern or flashlight showing a white light\n\nwhich shall be exhibited in sufficient time to avert collision; and\n\n9. Every vessel at anchor shall carry and exhibit an all-around\n\nwhite light in such a position where it may best be seen. The deck\n\nof an anchored vessel may be illuminated by available auxiliary\n\nlights, provided the auxiliary lights do not interfere with the\n\nvisibility of required lights or impair the safe navigation of other\n\nvessels.\n\nFor purposes of this section, \"restricted visibility\" shall mean any\n\ncondition which restricts visibility including but not limited to\n\nfog, mist, falling snow, heavy rain or sandstorm.\n\nC. Every vessel shall be provided with an efficient whistle or\n\nother sound-producing mechanical appliance; provided, however, no\n\nvessel, except for emergency and law enforcement vessels, shall be\n\nequipped with a siren.\n\nD. Every vessel of eight (8) meters or greater, or twenty-six\nndition which restricts visibility including but not limited to\n\nfog, mist, falling snow, heavy rain or sandstorm.\n\nC. Every vessel shall be provided with an efficient whistle or\n\nother sound-producing mechanical appliance; provided, however, no\n\nvessel, except for emergency and law enforcement vessels, shall be\n\nequipped with a siren.\n\nD. Every vessel of eight (8) meters or greater, or twenty-six\n\n(26) feet three (3) inches or greater, in length shall be equipped\n\nwith an efficient bell.\n\nE. Every vessel shall be required to carry:\n\n1. At least one wearable personal flotation device for each\n\nperson on board so placed as to be readily accessible and of a size\n\nsuitable to the person who is or will be wearing it; and\n\n2. At least one type IV (throwable) personal flotation device\n\non board, so placed as to be readily accessible. This paragraph\n\nshall not apply to any vessel under sixteen (16) feet in length.\n\nAll lifesaving devices shall be in good and serviceable condition.\n\nF. Every vessel using flammable liquid as fuel shall be\n\nequipped with such number, size, and type of United States Coast\n\nGuard approved fire extinguisher as prescribed in the rules of the\n\nDepartment of Public Safety. Such extinguisher shall be capable of\n\npromptly and effectively extinguishing burning fuel. Fire\n\nextinguishers shall be at all times kept in condition for immediate\n\nand effective use and shall be so placed and secured to the vessel\n\nas to be readily accessible.\n\nG. The provisions of subsections B, C, and E of this section\n\nshall not apply to vessels while competing in any race conducted\n\npursuant to Section 4205 of this title, or, if such vessels are\n\ndesigned and intended solely for racing, while engaged in such\n\nnavigation as is incidental to the tuning up of vessels and motors\n\nfor the race.\n\nH. Every vessel shall have the carburetor or carburetors of\n\nevery motor therein, except outboard motors, using any liquid as\n\nfuel, equipped with a United States Coast Guard or U.L. or S.A.E.\n\napproved backfire flame arrestor or other appropriate attachment, as\n\nprescribed by the rules of the Department of Public Safety.\n\nI. Every vessel, except open vessels, using any liquid as fuel\n\nshall be provided with such means as may be prescribed by the United\n\nStates Coast Guard for properly and efficiently ventilating the\n\nbilges of the motor and fuel tank compartments so as to remove any\n\nexplosive or inflammable gases.\n\nJ. No person shall operate or give permission for the operation\n\nof a vessel which is not equipped as required by this section or\n\nmodification thereof and as prescribed in the rules of the\n\nDepartment of Public Safety.\n\nK. Any motorized vessel, as defined in Section 4002 of this\n\ntitle, other than a personal watercraft, as defined by Section 4201\n\nof this title, that is sold or operated in this state shall be\n\nrequired to have a carbon monoxide warning sticker affixed in plain\n\nview to the interior of the vessel. The Department of Public Safety\n\nshall develop and approve a carbon monoxide warning sticker and\n\nliterature on the dangers of carbon monoxide and boating. The\n\nDepartment may approve a carbon monoxide warning sticker that has\n\nbeen approved by the United States Coast Guard for similar uses in\n\nother states. A carbon monoxide warning sticker already developed\n\nby a vessel manufacturer that is affixed to a vessel satisfies the\n\nrequirements of this subsection. After development and approval of\n\nthe sticker, the Department shall transfer the sticker design to\n\nService Oklahoma for printing and distribution. Service Oklahoma\n\nand its licensed operators shall provide the stickers along with\n\nliterature on the dangers of carbon monoxide and boating to vessel\n\nowners in annual registration materials at no cost and shall include\n\nthe stickers when an application for a certificate of title is made\n\nand the ownership of the vessel is transferred. Once a vessel is\nvice Oklahoma for printing and distribution.
