Stat. tit. 63, § 63-4214","heading":"Collision, accident, or other casualty - Rendering of","body":"assistance by vessel operator - Notice - Accident report - Notice to\n\nappear - Written report – Drug and alcohol test.\n\nA. The operator and/or passenger of a vessel involved in a\n\ncollision, accident, or other casualty, shall render to other\n\npersons involved in the collision, accident, or other casualty\n\nreasonable assistance as may be necessary and practicable and shall\n\nimmediately, by the quickest means of communication, give notice of\n\nsuch accident to the local police department if such accident occurs\n\nwithin a municipality, or to the office of the county sheriff or\n\nnearest state highway patrol headquarters after complying with the\n\nrequirements of this section. The operator of a vessel involved in\n\na collision, accident, or other casualty shall give his name,\n\naddress, and identification of his vessel, in writing, to any person\n\ninjured in the collision, accident, or other casualty and to the\n\nowner of any property damaged in the collision, accident, or other\n\ncasualty.\n\nB. Any operator of a vessel involved in a collision, accident,\n\nor other casualty who could be cited for a violation of the Oklahoma\n\nBoating Safety Regulation Act where the collision, accident or other\n\ncasualty resulted in the immediate death or great bodily injury, as\n\ndefined in subsection B of Section 646 of Title 21 of the Oklahoma\n\nStatutes, of any person shall submit to drug and alcohol testing as\n\nsoon as practicable after such collision, accident or other casualty\n\noccurs. The boating violation shall constitute probable cause for\n\npurposes of Section 752 of Title 47 of the Oklahoma Statutes and the\n\nprocedures found in Section 752 of Title 47 of the Oklahoma Statutes\n\nshall be followed to determine the presence of alcohol or controlled\n\ndangerous substances within the blood system of the operator of the\n\nvessel.\n\nC. If a collision, accident, or other casualty results in death\n\nor injury to a person or damage to property in excess of Two\n\nThousand Dollars ($2,000.00), the operator of the vessel involved in\n\nthe collision, accident, or other casualty shall file with the\n\nDepartment of Public Safety a full description of the collision,\n\naccident, or other casualty, and such information as the Department\n\nmay require. No person shall be prosecuted or subjected to any\n\npenalty for providing such report to the Department and any\n\nstatement or information included in such report shall not be\n\nreceived against the person upon any criminal investigation,\n\nproceeding or trial.\n\nD. Whenever a person is halted by any duly authorized peace\n\nofficer of this state for any violation of Chapters 70, 71 or 72 of\n\nthis title, which shall be punishable as a misdemeanor, and is not\n\ntaken before a magistrate as hereinbefore required or permitted, the\n\nofficer shall prepare in quadruplicate using the \"Oklahoma Uniform\n\nViolations Complaint\", a written notice to appear in court, such\n\nnotices to appear to be serially numbered, containing the name and\n\naddress of the person, the state registration number of the vessel,\n\nif any, the offense charged, the time and place when and where the\n\nperson shall appear in court, and such other pertinent information\n\nas may be necessary.\n\nE. The time specified in the notice to appear must be at least\n\nfive (5) calendar days after the alleged violation unless the person\n\ncharged with the violation shall demand an earlier hearing.\n\nF. The person charged with the violation may give his written\n\npromise to appear in court by signing the written notice to appear\n\nprepared by the officer, in which event the officer shall deliver a\n\ncopy of the notice to appear to the person, and thereupon the\n\nofficer shall not take the person into physical custody for the\n\nviolation.\n\nG. If the person charged with the violation is a minor, then\n\nthe citing officer shall ascertain from the minor the name and\n\naddress of the parents or legal guardian of the minor, and the\nr\n\nprepared by the officer, in which event the officer shall deliver a\n\ncopy of the notice to appear to the person, and thereupon the\n\nofficer shall not take the person into physical custody for the\n\nviolation.\n\nG. If the person charged with the violation is a minor, then\n\nthe citing officer shall ascertain from the minor the name and\n\naddress of the parents or legal guardian of the minor, and the\n\nofficer shall cause a copy of the \"violation\" to be mailed to the\n\naddress of the parents or legal guardian, within three (3) calendar\n\ndays after the date of violation.\n\nH. Except for felony violations, any duly authorized peace\n\nofficer of this state at the scene of a boating accident may issue a\n\nwritten notice to appear to the operator of a vessel involved in the\n\naccident when, based upon personal investigation, the officer has\n\nreasonable and probable grounds to believe that the person has\n\ncommitted any offense in connection with the accident.\n\nI. In accordance with any request duly made by an authorized\n\nofficial or agency of the United States, any information compiled or\n\notherwise available to the Department of Public Safety pursuant to\n\nthis section shall be transmitted to the official or agency of the\n\nUnited States.\n\nJ. Any employee or officer of an agency of this state, or\n\nemployee or officer of a municipality or county in this state, shall\n\nmake a written report to the Department of Public Safety if an\n\noccurrence involving a vessel or its equipment results in one or\n\nmore of the following:\n\n1. A person dies;\n\n2. A person is injured and requires medical treatment beyond\n\nfirst aid;\n\n3. Damage to the vessel and other property totals more than Two\n\nThousand Dollars ($2,000.00) or there is a complete loss of the\n\nvessel;\n\n4. A person disappears from the vessel under circumstances that\n\nindicate death or injury;\n\n5. A person drowns in swimming to retrieve a vessel that is\n\nadrift from its mooring or dock, having departed from a position of\n\ninherent safety such as a shore or pier;\n\n6. A person drowns while swimming from a vessel for pleasure\n\nand the vessel does not contribute to the drowning;\n\n7. A person drowns after falling from a vessel that is moored\n\nor anchored for use as a swimming platform or other purpose;\n\n8. A person dies or is injured while in the act of launching a\n\nvessel into a body of water;\n\n9. A person drowns or is injured while surfing;\n\n10. A fatality or injury occurs to an operator or a crew member\n\nwhile participating in an organized/sanctioned race, or warm-up, in\n\na vessel uniquely designed for racing; or\n\n11.
