The owner of a vessel shall be liable for any injury or\n\ndamage occasioned by the negligent operation of such vessel, whether\n\nsuch negligence consists of a violation of the provisions of the\n\nstatutes of this state, or the violation of any municipal ordinance,\n\nor neglecting to observe such ordinary care and such operation as\n\nthe rules of the common law require. The owner shall not be liable,\n\nhowever, unless such vessel is being used with his or her express or\n\nimplied consent. Nothing contained herein shall be construed to\n\nrelieve any other person from any liability which he or she would\n\notherwise have.\n\nB. The owner of a vessel shall not be liable for any injury or\n\ndamage occasioned by the negligent operation of the vessel as\n\nprovided in subsection A of this section if:\n\n1. The owner is engaged in the trade or business of renting or\n\nleasing vessels;\n\n2. The owner is in compliance with the Oklahoma Vessel and\n\nMotor Registration Act, Section 4001 et seq. of this title;\n\n3. The injury or damage occurred during a period of rental or\n\nlease;\n\n4. The owner did not knowingly permit or entrust the vessel to\n\nbe operated by a reckless or otherwise incompetent operator where\n\nthe owner knew or should have known that the injury or damage would\n\nhave occurred; and\n\n5. The owner has:\n\na. briefed the renter of the vessel on the location of\n\nfire extinguishers and life vests when applicable,\n\nb. ensured there are enough life vests of the proper size\n\nfor every passenger on the boat,\n\nc. presented guidelines to the renter for safely piloting\n\na vessel, and\n\nd. executed a safety check on lighting, gasoline, oil,\n\nand bilge water removal systems.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"95b734dd24d68f38821b49104a4fe38f68ddcd9d2a21e3334566cfd3564fc5d8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-4214","next":"us-ok/okla.-stat.-tit.-63-63-4216"},"notice":"GroundRules: Original legal text.
