Stat. tit. 63, § 63-422","heading":"Medical marijuana commercial grower license application –","body":"Fee – Criteria for license.\n\nA. The Oklahoma Medical Marijuana Authority shall make\n\navailable on its website in an easy-to-find location an application\n\nfor a medical marijuana commercial grower license. The application\n\nfee shall be paid by the applicant in the amounts provided for in\n\nSection 427.14 of this title. A method of payment for the\n\napplication fee shall be provided on the website of the Authority.\n\nThe Authority shall have ninety (90) business days to review the\n\napplication; approve, reject, or deny the application; and send the\n\napproval, rejection, or denial letter stating the reasons for the\n\nrejection or denial to the applicant in the same method the\n\napplication was submitted to the Authority.\n\nB. The Authority shall approve all applications which meet the\n\nfollowing criteria:\n\n1. The applicant must be twenty-five (25) years of age or\n\nolder;\n\n2. The applicant, if applying as an individual, must show\n\nresidency in this state;\n\n3. All applying entities must show that all members, managers,\n\nand board members are Oklahoma residents;\n\n4. An applying entity may show ownership of non-Oklahoma\n\nresidents, but that percentage ownership may not exceed twenty-five\n\npercent (25%);\n\n5. All applying individuals or entities must be registered to\n\nconduct business in this state; and\n\n6. All applicants must disclose all ownership interests in the\n\ncommercial grower operation.\n\nApplicants with a nonviolent felony conviction in the last two\n\n(2) years, any other felony conviction in the last five (5) years,\n\ninmates in the custody of the Department of Corrections or any\n\nperson currently incarcerated shall not qualify for a commercial\n\ngrower license.\n\nC. A licensed medical marijuana commercial grower may sell\n\nmarijuana to a licensed medical marijuana dispensary or a licensed\n\nmedical marijuana processor. Further, sales by a licensed medical\n\nmarijuana commercial grower shall be considered wholesale sales and\n\nshall not be subject to taxation. Under no circumstances may a\n\nlicensed medical marijuana commercial grower sell marijuana directly\n\nto a licensed medical marijuana patient or licensed medical\n\nmarijuana caregiver. A licensed medical marijuana commercial grower\n\nmay only sell at the wholesale level to a licensed medical marijuana\n\ndispensary, a licensed medical marijuana commercial grower or a\n\nlicensed medical marijuana processor. If the federal government\n\nlifts restrictions on buying and selling marijuana between states,\n\nthen a licensed medical marijuana commercial grower would be allowed\n\nto sell and buy marijuana wholesale from, or to, an out-of-state\n\nwholesale provider. A licensed medical marijuana commercial grower\n\nshall be required to complete a monthly yield and sales report to\n\nthe Authority. This report shall be due on the fifteenth of each\n\nmonth and provide reporting on the previous month. This report\n\nshall detail the amount of marijuana harvested in pounds, the amount\n\nof drying or dried marijuana on hand, the amount of marijuana sold\n\nto licensed processors in pounds, the amount of waste in pounds, and\n\nthe amount of marijuana sold to licensed medical marijuana\n\ndispensaries in pounds. Additionally, this report shall show total\n\nwholesale sales in dollars. The Authority shall have oversight and\n\nauditing responsibilities to ensure that all marijuana being grown\n\nby licensed medical marijuana commercial growers is accounted for.\n\nD. There shall be no limits on how much marijuana a licensed\n\nmedical marijuana commercial grower can grow.\n\nE. Beginning on November 1, 2021, licensed medical marijuana\n\ncommercial growers shall be authorized to package and sell pre-\n\nrolled marijuana to licensed medical marijuana dispensaries. The\n\nproducts described in this subsection shall contain only the ground\n\nparts of the marijuana plant and shall not include marijuana\n\nconcentrates or derivatives. The total net weight of each pre-roll\nan grow.\n\nE. Beginning on November 1, 2021, licensed medical marijuana\n\ncommercial growers shall be authorized to package and sell pre-\n\nrolled marijuana to licensed medical marijuana dispensaries. The\n\nproducts described in this subsection shall contain only the ground\n\nparts of the marijuana plant and shall not include marijuana\n\nconcentrates or derivatives. The total net weight of each pre-roll\n\npackaged and sold by licensed medical marijuana commercial growers\n\nshall not exceed one (1) gram. These final products must be tested,\n\npackaged and labeled in accordance with Oklahoma law and rules\n\npromulgated by the Authority.\n\nF. Beginning November 1, 2022, all medical marijuana commercial\n\ngrower licensees who operate an outdoor medical marijuana production\n\nfacility shall be required to register with the Oklahoma Department\n\nof Agriculture, Food, and Forestry as an environmentally sensitive\n\ncrop owner. Registration shall provide notice to commercial and\n\nprivate pesticide applicators of the locations of medical marijuana\n\ncrops and help minimize the potential for damaging pesticide drift.\n\nMedical marijuana commercial grower licensees shall provide their\n\nbusiness name, address, Global Positioning System (GPS) coordinates\n\nfor all outdoor medical marijuana production facilities, and any\n\nother information required by the Department when registering with\n\nthe Environmentally Sensitive Area Registry.\n\nAdded by Section 3, State Question No. 788, Initiative Petition No.\n\n412, adopted at election held June 26, 2018, eff.
