Any parent, legal guardian or person having actual\n\nresponsibility for a person under sixteen (16) years of age, or who\n\nis the owner of the vessel operated by a person under sixteen (16)\n\nyears of age, who knows, or should have known, that the person\n\noperating the vessel is not in compliance with the certification\n\nrequired by Section 2 of this act shall constitute a misdemeanor\n\nand, upon conviction thereof, shall be punishable by a fine of not\n\nless than Fifty Dollars ($50.00) nor more than One Hundred Dollars\n\n($100.00). Any second or subsequent conviction shall be punishable\n\nby a fine in an amount of not less than Two Hundred Fifty Dollars\n\n($250.00), nor more than Five Hundred Dollars ($500.00).\n\nB. A violation of the provisions of Section 2 of this act shall\n\nconstitute a misdemeanor and, upon conviction thereof, shall be\n\npunishable by a fine of not less than Two Hundred Fifty Dollars\n\n($250.00) nor more than One Thousand Dollars ($1,000.00).\n\nC. All fines collected under this section shall be deposited to\n\nthe Boating Safety Education Fund administered by the State Boating\n\nLaw Administrator as designated by the Commissioner of Public Safety\n\nfor the purpose of establishing, maintaining and operating a program\n\nof boating safety education throughout the State of Oklahoma.\n\nD. A court may defer the imposition of a fine and place a\n\ndefendant on probation for a period not to exceed sixty (60) days if\n\nthe defendant:\n\n1. Is a first-time violator of a provision of this section;\n\n2. Pleads guilty or nolo contendere or is found guilty;\n\n3. Requests permission from the court to attend a boating\n\nsafety education course; and\n\n4. Successfully completes a boating safety education course\n\napproved by the Department of Public Safety during the probation\n\nperiod.\n\nE. Any person producing proof in court that a valid Boating\n\nSafety Education Certificate or equivalent form recognized by the\n\nDepartment of Public Safety reflecting such person has successfully\n\ncompleted a boating safety education course or is exempt from such\n\ncourse was in effect at the time of the alleged offense of Section 2\n\nof this act shall be entitled to dismissal of such charge upon\n\npayment of court costs.
