The tax on retail medical marijuana sales shall be\n\nestablished at seven percent (7%) of the gross amount received by\n\nthe seller.\n\nB. This tax shall be collected at the point of sale. Except as\n\nprovided for in subsection D, tax proceeds shall be deposited into\n\nthe Medical Marijuana Tax Fund created in Section 3 of this act.\n\nC. Pursuant to Section 255.2 of Title 68 of the Oklahoma\n\nStatutes, the Oklahoma Tax Commission shall have authority to\n\nassess, collect and enforce the tax specified in subsection A of\n\nthis section including any interest and penalty thereon.\n\nD. For fiscal year 2022, proceeds from the levy authorized by\n\nsubsection A of this section shall be apportioned as follows:\n\n1. The first Sixty-five Million Dollars ($65,000,000.00) shall\n\nbe apportioned as follows:\n\na. fifty-nine and twenty-three hundredths percent\n\n(59.23%) to the State Public Common School Building\n\nEqualization Fund,\n\nb. thirty-four and sixty-two hundredths percent (34.62%)\n\nto the Oklahoma Medical Marijuana Authority, a\n\ndivision within the State Department of Health, and\n\nc. six and fifteen hundredths percent (6.15%) to the\n\nState Department of Health and earmarked for drug and\n\nalcohol rehabilitation; and\n\n2. Any surplus collections shall be apportioned to the General\n\nRevenue Fund of the State Treasury.\n\nE. If any medical marijuana business licensee intentionally\n\ndoes not remit the taxes as required by the provisions of this\n\nsection or the provisions of Section 1354 of Title 68 of the\n\nOklahoma Statutes, the Authority shall permanently revoke the\n\nmedical marijuana business license of the business licensee and the\n\nbusiness licensee shall be permanently ineligible to receive any\n\nother type of medical marijuana business license issued by the\n\nAuthority, including licenses for a dispensary, commercial grower\n\noperation, processing facility, transporter, research, education\n\nfacility, and waste disposal facility.\n\nAdded by Section 7, State Question No. 788, Initiative Petition No.\n\n412, adopted at election held June 26, 2018, eff.
