Only licensed Oklahoma allopathic, osteopathic and podiatric\n\nphysicians may provide a medical marijuana recommendation for a\n\nmedical marijuana patient license under the Oklahoma Medical\n\nMarijuana and Patient Protection Act.\n\nB. A physician who has not completed his or her first residency\n\nshall not meet the definition of “physician” under this section and\n\nany recommendation for a medical marijuana patient license shall not\n\nbe processed by the Oklahoma Medical Marijuana Authority.\n\nC. No physician shall be subject to arrest, prosecution or\n\npenalty in any manner or denied any right or privilege under state,\n\nmunicipal or county statute, ordinance or resolution, including\n\nwithout limitation a civil penalty or disciplinary action by the\n\nState Board of Medical Licensure and Supervision, the State Board of\n\nOsteopathic Examiners, the Board of Podiatric Medical Examiners or\n\nby any other business, occupation or professional licensing board or\n\nbureau, solely for providing a medical marijuana recommendation for\n\na patient or for monitoring, treating or prescribing scheduled\n\nmedication to patients who are medical marijuana licensees. The\n\nprovisions of this subsection shall not prevent the relevant\n\nprofessional licensing boards from sanctioning a physician for\n\nfailing to properly evaluate the medical condition of a patient or\n\nfor otherwise violating the applicable physician-patient standard of\n\ncare.\n\nD. A physician who recommends use of medical marijuana shall\n\nnot be located at the same physical address as a licensed medical\n\nmarijuana dispensary.\n\nE. If the physician determines the continued use of medical\n\nmarijuana by the patient no longer meets the requirements set forth\n\nin the Oklahoma Medical Marijuana and Patient Protection Act, the\n\nphysician shall notify the Oklahoma Medical Marijuana Authority and\n\nthe license shall be immediately voided without right to an\n\nindividual proceeding.\n\nF. The Authority shall create and maintain a registry of\n\nrecommending physicians. Beginning January 1, 2026, to be eligible\n\nto provide a medical marijuana recommendation to a licensed patient,\n\na physician shall be registered with the Authority.\n\nG. To be registered with the Authority, a physician shall\n\ncomply with the medical education and continuing medical education\n\nrequirements described in this section and shall meet all other\n\nrequirements established by law or rule for the recommending\n\nphysician’s respective licensure board. The medical education\n\nrelated to medical marijuana shall be completed prior to the\n\nphysician being listed on the registry and shall be completed\n\nannually to remain on the registry.\n\nH. The Executive Director of the Oklahoma Medical Marijuana\n\nAuthority shall promulgate rules to establish initial medical\n\neducation and continuing medical education requirements for\n\nrecommending physicians. The State Board of Medical Licensure and\n\nSupervision, the State Board of Osteopathic Examiners, and the Board\n\nof Podiatric Medical Examiners may consult with the Executive\n\nDirector of the Authority to develop or identify a list of approved\n\nmedical education courses for recommending physicians.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"95edf154e16f66ed1327857bd08b751f6ce02f0c89025e8ee49316cdf9f8331a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-427.1","next":"us-ok/okla.-stat.-tit.-63-63-427.11"},"notice":"GroundRules: Original legal text.
