There is hereby created a medical marijuana transporter\n\nlicense as a category of the medical marijuana business license.\n\nB. Pursuant to Section 424 of this title, the Oklahoma Medical\n\nMarijuana Authority shall issue a medical marijuana transporter\n\nlicense to licensed medical marijuana commercial growers,\n\nprocessors, and dispensaries upon issuance of such licenses and upon\n\neach renewal. Medical marijuana transporter licenses shall also be\n\nissued to licensed medical marijuana research facilities, medical\n\nmarijuana education facilities, and medical marijuana testing\n\nlaboratories upon issuance of such licenses and upon each renewal.\n\nC. A medical marijuana transporter license may also be issued\n\nto qualifying applicants who are registered with the Secretary of\n\nState and otherwise meet the requirements for a medical marijuana\n\nbusiness license set forth in the Oklahoma Medical Marijuana and\n\nPatient Protection Act and the requirements set forth in this\n\nsection to provide logistics, distribution, and storage of medical\n\nmarijuana, medical marijuana concentrate, and medical marijuana\n\nproducts.\n\nD. A medical marijuana transporter license shall be valid for\n\none (1) year and shall not be transferred with a change of\n\nownership. A licensed medical marijuana transporter shall be\n\nresponsible for all medical marijuana, medical marijuana\n\nconcentrate, and medical marijuana products once the transporter\n\ntakes control of the product.\n\nE. A transporter license shall be required for any person or\n\nentity to transport or transfer medical marijuana, medical marijuana\n\nconcentrate, or medical marijuana products from a licensed medical\n\nmarijuana business to another medical marijuana business, or from a\n\nmedical marijuana business to a medical marijuana research facility\n\nor medical marijuana education facility.\n\nF. A medical marijuana transporter licensee may contract with\n\nmultiple licensed medical marijuana businesses.\n\nG. A medical marijuana transporter may maintain a licensed\n\npremises to temporarily store medical marijuana, medical marijuana\n\nconcentrate, and medical marijuana products and to use as a\n\ncentralized distribution point. A medical marijuana transporter may\n\nstore and distribute medical marijuana, medical marijuana\n\nconcentrate, and medical marijuana products from the licensed\n\npremises. The licensed premises shall meet all security\n\nrequirements applicable to a medical marijuana business. The\n\nAuthority shall issue licenses upon proper application by a licensee\n\nand determination by the Authority that the proposed site and\n\nfacility are physically and technically suitable.\n\nH. A medical marijuana transporter licensee shall use the seed-\n\nto-sale tracking system developed pursuant to the Oklahoma Medical\n\nMarijuana and Patient Protection Act to create inventory manifests\n\ndocumenting the transport or temporary storage of medical marijuana,\n\nmedical marijuana concentrate, and medical marijuana products\n\nthroughout the state.\n\nI. A licensed medical marijuana transporter may maintain and\n\noperate one or more warehouses in the state to handle medical\n\nmarijuana, medical marijuana concentrate, and medical marijuana\n\nproducts, provided the licensed medical marijuana transporter\n\npossesses a valid, unexpired medical marijuana transporter license\n\nand has applied for and received a permit for each warehouse\n\nlocation. The Authority shall issue an annual permit for each\n\nwarehouse location operated by a licensee that is tied to the annual\n\nmedical marijuana transporter license term, and there shall be no\n\nlimit to the number of permits issued under a medical marijuana\n\ntransporter license. A permit shall be issued only upon proper\n\napplication by a licensee and determination by the Authority that\n\nthe proposed site and facility are physically and technically\neach\n\nwarehouse location operated by a licensee that is tied to the annual\n\nmedical marijuana transporter license term, and there shall be no\n\nlimit to the number of permits issued under a medical marijuana\n\ntransporter license. A permit shall be issued only upon proper\n\napplication by a licensee and determination by the Authority that\n\nthe proposed site and facility are physically and technically\n\nsuitable. Upon a finding that a proposed warehouse location is not\n\nphysically or technically suitable, the Authority shall deny the\n\npermit. Each warehouse location shall be approved and inspected by\n\nthe Authority prior to its use. Medical marijuana transporter\n\nwarehouses that are licensed and approved by the Authority may\n\ntemporarily store medical marijuana, medical marijuana concentrate,\n\nand medical marijuana products, provided that all temporary storage\n\nis documented, tracked, and traceable in the state-mandated seed-to-\n\nsale tracking system.\n\nJ. With the exception of a lawful transfer between medical\n\nmarijuana businesses who are licensed to operate at the same\n\nphysical address, all medical marijuana, medical marijuana\n\nconcentrate, and medical marijuana products shall be transported:\n\n1. In vehicles equipped with Global Positioning System (GPS)\n\ntrackers;\n\n2. In a locked container and clearly labeled “Medical Marijuana\n\nor Derivative”; and\n\n3. In a secured area of the vehicle that is not accessible by\n\nthe driver during transit.\n\nK. A transporter agent may possess marijuana at any location\n\nwhile the transporter agent is transferring marijuana to or from a\n\nlicensed medical marijuana business, licensed medical marijuana\n\nresearch facility, or licensed medical marijuana education facility.\n\nThe Authority shall administer the provisions of this section and\n\nthe Authority, the Oklahoma State Bureau of Narcotics and Dangerous\n\nDrugs Control, the Oklahoma State Bureau of Investigation, and the\n\nAttorney General shall have the authority to enforce the provisions\n\nof this section concerning transportation.\n\nL. The Authority shall issue a transporter agent license to\n\nindividual agents, employees, officers, or owners of a transporter\n\nlicense in order for the individual to qualify to transport medical\n\nmarijuana, medical marijuana concentrate, or medical marijuana\n\nproducts.\n\nM. The annual fee for a transporter agent license shall be\n\nTwenty-five Dollars ($25.00) and shall be paid by the transporter\n\nlicense-holder or the individual applicant. Transporter agent\n\nlicense reprints shall be Twenty Dollars ($20.00).\n\nN. The Authority shall issue each transporter agent a registry\n\nidentification card within thirty (30) days of receipt of:\n\n1. The name, address, and date of birth of the person;\n\n2. Proof of current state residency;\n\n3. Proof of identity as required for a medical marijuana\n\nbusiness license;\n\n4. Possession of a valid state-issued driver license;\n\n5. Verification of employment with a licensed transporter;\n\n6. The application and affiliated fee; and\n\n7. A copy of the criminal background check conducted by the\n\nOklahoma State Bureau of Investigation, paid for by the applicant.\n\nO. If the transporter agent application is denied, the\n\nAuthority shall notify the transporter in writing of the reason for\n\ndenying the registry identification card.\n\nP. A registry identification card for a transporter shall\n\nexpire one (1) year after the date of issuance or upon notification\n\nfrom the holder of the transporter license that the transporter\n\nagent ceases to work as a transporter.\n\nQ. The Authority may revoke the registry identification card of\n\na transporter agent who knowingly violates any provision of this\n\nsection, and the transporter is subject to any other penalties\n\nestablished by law for the violation.\n\nR. The Authority may revoke or suspend the transporter license\n\nof a transporter that the Authority determines knowingly aided or\nnt ceases to work as a transporter.\n\nQ. The Authority may revoke the registry identification card of\n\na transporter agent who knowingly violates any provision of this\n\nsection, and the transporter is subject to any other penalties\n\nestablished by law for the violation.\n\nR. The Authority may revoke or suspend the transporter license\n\nof a transporter that the Authority determines knowingly aided or\n\nfacilitated a violation of any provision of this section, and the\n\nlicense holder is subject to any other penalties established in law\n\nfor the violation.\n\nS. Vehicles used in the transport of medical marijuana or\n\nmedical marijuana product shall be:\n\n1. Insured at or above the legal requirements in this state;\n\n2. Capable of securing medical marijuana during transport; and\n\n3. In possession of a shipping container as defined in Section\n\n427.2 of this title capable of securing all transported products.\n\nT. Prior to the transport of any medical marijuana, medical\n\nmarijuana concentrate, or medical marijuana products, an inventory\n\nmanifest shall be prepared at the origination point of the medical\n\nmarijuana. The inventory manifest shall include the following\n\ninformation:\n\n1. For the origination point of the medical marijuana:\n\na. the licensee number for the commercial grower,\n\nprocessor, or dispensary,\n\nb. the address of origination of transport, and\n\nc. the name and contact information for the originating\n\nlicensee;\n\n2. For temporary storage at a medical marijuana transporter\n\nlicensed premises or warehouse location that is licensed and\n\napproved by the Authority:\n\na. the license number for the commercial medical\n\nmarijuana grower, medical marijuana processor, or\n\nmedical marijuana dispensary,\n\nb. the address of origination of transport,\n\nc. the name and contact information for the originating\n\nlicensee, and\n\nd. the license number, physical address, and name and\n\ncontact information of the medical marijuana\n\ntransporter licensed premises or warehouse location\n\nand notation that the medical marijuana, medical\n\nmarijuana concentrate, and medical marijuana products\n\nare being temporarily stored;\n\n3. For the end recipient license holder of the medical\n\nmarijuana:\n\na. the license number for the dispensary, commercial\n\ngrower, processor, research facility, or education\n\nfacility destination,\n\nb. the address of the destination, and\n\nc. the name and contact information for the destination\n\nlicensee;\n\n4. Quantities by weight or unit of each type of medical\n\nmarijuana product contained in transport;\n\n5. The date of the transport and the approximate time of\n\ndeparture;\n\n6. The arrival date and estimated time of arrival;\n\n7. Printed names and signatures of the personnel accompanying\n\nthe transport; and\n\n8. Notation of the transporting licensee.\n\nU. 1. A separate inventory manifest shall be prepared for each\n\nlicensee receiving the medical marijuana.\n\n2. The transporter agent shall provide the other medical\n\nmarijuana business with a copy of the inventory manifest at the time\n\nthe product changes hands and after the other licensee prints his or\n\nher name and signs the inventory manifest.\n\n3. A receiving licensee shall refuse to accept any medical\n\nmarijuana, medical marijuana concentrate, or medical marijuana\n\nproducts that are not accompanied by an inventory manifest.\n\n4. Originating and receiving licensees, including medical\n\nmarijuana transporter warehouses temporarily storing medical\n\nmarijuana, medical marijuana concentrate, and medical marijuana\n\nproducts, shall maintain copies of inventory manifests and logs of\n\nquantities of medical marijuana received for seven (7) years from\n\ndate of receipt.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0f557b0a0049b0bcabaf41409f543b951e031fbc795e38c5d7332b99ea039c9f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-427.15a","next":"us-ok/okla.-stat.-tit.-63-63-427.17"},"notice":"GroundRules: Original legal text.
