A medical marijuana business shall not sell, transfer or\n\notherwise distribute medical marijuana or medical marijuana product\n\nthat has not been packaged and labeled in accordance with this\n\nsection and rules promulgated by the Executive Director of the\n\nOklahoma Medical Marijuana Authority.\n\nB. A medical marijuana dispensary shall return medical\n\nmarijuana and medical marijuana product that does not meet packaging\n\nor labeling requirements in this section or rules promulgated\n\npursuant thereto to the entity who transferred it to the dispensary.\n\nThe medical marijuana dispensary shall document to whom the item was\n\nreturned, what was returned, and the date of the return, or dispose\n\nof any usable marijuana that does not meet these requirements in\n\naccordance with the Oklahoma Medical Marijuana and Patient\n\nProtection Act.\n\nC. 1. Medical marijuana packaging shall be packaged to\n\nminimize its appeal to children and shall not depict images other\n\nthan the business name logo of the medical marijuana producer and\n\nimage of the product.\n\n2. A medical marijuana business shall not place any content on\n\na container in a manner that reasonably appears to target\n\nindividuals under the age of twenty-one (21) including, but not\n\nlimited to, cartoon characters or similar images.\n\n3. Labels on a container shall not include any false or\n\nmisleading statements.\n\n4. No container shall be intentionally or knowingly labeled so\n\nas to cause a reasonable patient confusion as to whether the medical\n\nmarijuana, medical marijuana concentrate or medical marijuana\n\nproduct is a trademarked product or labeled in a manner that\n\nviolates any federal trademark law or regulation. The label on the\n\ncontainer shall include a warning that states the following:\n\na. “For use by licensed medical marijuana patients only”,\n\nb. “Keep out of reach of children”,\n\nc. “It is illegal to drive a motor vehicle while under\n\nthe influence of marijuana or marijuana products”,\n\nd. “Women should not use marijuana or marijuana products\n\nduring pregnancy because of the risk of birth\n\ndefects”, and\n\ne. “This product has been tested for contaminants”.\n\n5. The label on the container shall not make any claims\n\nregarding health or physical benefits to the patient.\n\n6. The container itself may be clear in order to allow licensed\n\nmedical marijuana patients and licensed medical marijuana caregivers\n\nthe ability to view the product inside the container but shall be\n\nchild-resistant, as defined in Section 427.2 of this title.\n\n7. At the point of sale and transfer of any medical marijuana,\n\nmedical marijuana concentrate, or medical marijuana products to a\n\nlicensed medical marijuana patient or licensed medical marijuana\n\ncaregiver, the dispensary shall place the medical marijuana, medical\n\nmarijuana concentrate, or medical marijuana products in an exit\n\npackage, as such term is defined in Section 427.2 of this title.\n\nD. The Executive Director shall develop minimum standards for\n\npackaging and labeling of medical marijuana, medical marijuana\n\nconcentrate, and medical marijuana products. Such standards shall\n\ninclude, but not be limited to, the required contents of labels to\n\nbe affixed to all medical marijuana, medical marijuana concentrate,\n\nand medical marijuana products prior to transfer to a licensed\n\npatient or caregiver, which shall include, at a minimum:\n\n1. THC and other cannabinoid potency, and terpenoid potency;\n\n2. A statement indicating that the product has been tested for\n\ncontaminants;\n\n3. One or more product warnings to be determined by the\n\nExecutive Director; and\n\n4.
