A medical marijuana research license may be issued to a\n\nperson to grow, cultivate, possess and transfer, by sale or\n\ndonation, marijuana pursuant to the Oklahoma Medical Marijuana and\n\nPatient Protection Act for the limited research purposes identified\n\nin this section.\n\nB. The annual fee for a medical marijuana research license\n\nshall be Five Hundred Dollars ($500.00) and shall be payable by an\n\napplicant for a medical marijuana research license upon submission\n\nof his or her application to the Oklahoma Medical Marijuana\n\nAuthority.\n\nC. A medical marijuana research license may be issued for the\n\nfollowing research purposes:\n\n1. To test chemical potency and composition levels;\n\n2. To conduct clinical investigations of marijuana-derived\n\nmedicinal products;\n\n3. To conduct research on the efficacy and safety of\n\nadministering marijuana as part of medical treatment;\n\n4. To conduct genomic, horticultural or agricultural research;\n\nand\n\n5. To conduct research on marijuana-affiliated products or\n\nsystems.\n\nD. 1. As part of the application process for a medical\n\nmarijuana research license, an applicant shall submit to the\n\nAuthority a description of the research that the applicant intends\n\nto conduct and whether the research will be conducted with a public\n\ninstitution or using public money. If the research will not be\n\nconducted with a public institution or with public money, the\n\nAuthority shall grant the application if it determines that the\n\napplicant meets the criteria in this section.\n\n2. If the research will be conducted with a public institution\n\nor public money, the Authority shall review the research project of\n\nthe applicant to determine if it meets the requirements of this\n\nsection and to assess the following:\n\na. the quality, study design, value or impact of the\n\nproject,\n\nb. whether the applicant has the appropriate personnel,\n\nexpertise, facilities, infrastructure, funding and\n\nhuman, animal or other approvals in place to\n\nsuccessfully conduct the project, and\n\nc. whether the amount of marijuana to be grown by the\n\napplicant is consistent with the scope and goals of\n\nthe project.\n\n3. If the Authority determines that the research project does\n\nnot meet the requirements of this section or assesses the criteria\n\nto be inadequate, the application shall be denied.\n\nE. A medical marijuana research licensee may only transfer, by\n\nsale or donation, marijuana grown within its operation to other\n\nmedical marijuana research licensees. The Authority may revoke a\n\nmedical marijuana research license for violations of this section\n\nand any other violation of the Oklahoma Medical Marijuana and\n\nPatient Protection Act.\n\nF. A medical marijuana research licensee may contract to\n\nperform research in conjunction with a public higher education\n\nresearch institution or another medical marijuana research licensee.\n\nG. The growing, cultivating, possessing or transferring, by\n\nsale or donation, of marijuana in accordance with this section and\n\nthe rules promulgated pursuant thereto, by a medical marijuana\n\nresearch licensee shall not be a criminal or civil offense under\n\nstate law. A medical marijuana research license shall be issued in\n\nthe name of the applicant and shall specify the location in this\n\nstate at which the medical marijuana research licensee intends to\n\noperate. A medical marijuana research licensee shall not allow any\n\nother person to exercise the privilege of the license.\n\nH. If the research conducted includes a public institution or\n\npublic money, the Authority shall review any reports made by medical\n\nmarijuana research licensees under state licensing authority rule\n\nand provide the Authority with its determination on whether the\n\nresearch project continues to meet research qualifications pursuant\n\nto this section.\n\nI. Submission of an application for a medical marijuana\n\nresearch license shall constitute permission for entry to and\nmoney, the Authority shall review any reports made by medical\n\nmarijuana research licensees under state licensing authority rule\n\nand provide the Authority with its determination on whether the\n\nresearch project continues to meet research qualifications pursuant\n\nto this section.\n\nI. Submission of an application for a medical marijuana\n\nresearch license shall constitute permission for entry to and\n\ninspection of the facility of the medical marijuana research\n\nlicensee during hours of operation and other reasonable times.\n\nRefusal to permit such entry for inspection shall constitute grounds\n\nfor the nonrenewal, suspension, or revocation of the medical\n\nmarijuana research license. The Authority, the Oklahoma State\n\nBureau of Narcotics and Dangerous Drugs Control, the Oklahoma State\n\nBureau of Investigation, and the Attorney General may perform an\n\nunannounced, on-site inspection of the operations and any facility\n\nof the medical marijuana research licensee. If the Authority\n\nreceives a complaint concerning noncompliance by a medical marijuana\n\nresearch licensee, the Authority, the Oklahoma State Bureau of\n\nNarcotics and Dangerous Drugs Control, the Oklahoma State Bureau of\n\nInvestigation, and the Attorney General may conduct additional\n\nunannounced, on-site inspections beyond the required biannual\n\ninspections provided for in Section 427.6 of this title.
