Stat. tit. 63, § 63-427.20","heading":"Medical marijuana education facility license -","body":"Requirements.\n\nA. There is hereby created a medical marijuana education\n\nfacility license.\n\nB. A medical marijuana education facility license may be issued\n\nto a person to possess or cultivate marijuana for the limited\n\neducation and research purposes identified in this section.\n\nC. A medical marijuana education facility license may only be\n\ngranted to a not-for-profit organization structured under Section\n\n501(c)(3) of the Internal Revenue Code, operating as a not-for-\n\nprofit organization in this state registered with the Office of the\n\nSecretary of State.\n\nD. A medical marijuana education facility license may only be\n\ngranted upon the submission of an annual fee of Five Hundred Dollars\n\n($500.00) to the Oklahoma Medical Marijuana Authority.\n\nE. A medical marijuana education facility license may be issued\n\nfor the following education and research purposes:\n\n1. To test cultivation techniques, strategies, infrastructure,\n\nmediums, lighting and other related technology;\n\n2. To demonstrate cultivation techniques, strategies,\n\ninfrastructure, mediums, lighting and other related technology;\n\n3. To demonstrate the application and use of product\n\nmanufacturing technologies;\n\n4. To conduct genomic, horticultural or agricultural research;\n\nand\n\n5. To conduct research on marijuana-affiliated products or\n\nsystems.\n\nF. As part of the application process for a medical marijuana\n\neducation facility license, an applicant shall submit to the\n\nAuthority a description of the project and curriculum that the\n\napplicant intends to conduct and whether the project and curriculum\n\nwill be conducted with a public institution or using public money.\n\nIf the project and curriculum will not be conducted with a public\n\ninstitution or with public money, the Authority shall grant the\n\napplication. If the research will be conducted with a public\n\ninstitution or public money, the Authority shall review the research\n\nproject of the applicant to determine if it meets the requirements\n\nof this section and to assess the following:\n\n1. The quality, study design, value or impact of the project;\n\n2. Whether the applicant has the appropriate personnel,\n\nexpertise, facilities, infrastructure, funding and human, animal or\n\nother approvals in place to successfully conduct the project; and\n\n3. Whether the amount of marijuana to be grown by the applicant\n\nis consistent with the scope and goals of the project.\n\nIf the Authority determines that the education project does not meet\n\nthe requirements of this section or assesses the criteria to be\n\ninadequate, the application shall be denied.\n\nG. A medical marijuana education facility licensee may only\n\ntransfer, by sale or donation, marijuana grown within its operation\n\nto medical marijuana research licensees. The Authority may revoke a\n\nmedical marijuana education facility license for violations of this\n\nsection and any other violation of applicable laws, rules and\n\nregulations.\n\nH. A medical marijuana education facility licensee may contract\n\nto perform research in conjunction with a public higher education\n\nresearch institution or another research licensee.\n\nI. The growing, cultivating, possessing or transferring, by\n\nsale or donation, of marijuana in accordance with this section and\n\nthe rules promulgated pursuant thereto, by a medical marijuana\n\neducation facility licensee shall not be a criminal or civil offense\n\nunder state law. A medical marijuana education facility license\n\nshall be issued in the name of the applicant and shall specify the\n\nlocation in this state at which the medical marijuana education\n\nfacility licensee intends to operate. A medical marijuana education\n\nfacility licensee shall not allow any other person to exercise the\n\nprivilege of the license.\n\nJ. Submission of an application for a medical marijuana\n\neducation facility license shall constitute permission for entry to\ne name of the applicant and shall specify the\n\nlocation in this state at which the medical marijuana education\n\nfacility licensee intends to operate. A medical marijuana education\n\nfacility licensee shall not allow any other person to exercise the\n\nprivilege of the license.\n\nJ. Submission of an application for a medical marijuana\n\neducation facility license shall constitute permission for entry to\n\nand inspection of the facility of the medical marijuana education\n\nfacility licensee during hours of operation and other reasonable\n\ntimes. Refusal to permit such entry for inspection shall constitute\n\ngrounds for the nonrenewal, suspension, or revocation of the medical\n\nmarijuana education facility license. The Authority, the Oklahoma\n\nState Bureau of Narcotics and Dangerous Drugs Control, the Oklahoma\n\nState Bureau of Investigation, and the Attorney General may perform\n\nan unannounced, on-site inspection of the operations and any\n\nfacility of the medical marijuana education facility licensee. If\n\nthe Authority receives a complaint concerning noncompliance by a\n\nmedical marijuana education facility licensee, the Authority, the\n\nOklahoma State Bureau of Narcotics and Dangerous Drugs Control, the\n\nOklahoma State Bureau of Investigation, and the Attorney General may\n\nconduct additional unannounced, on-site inspections beyond the\n\ninspections provided for in Section 427.6 of this title.
