Whenever an authorized agent of the Oklahoma Medical\n\nMarijuana Authority finds, in whole or in part, that the medical\n\nmarijuana or medical marijuana product fails to meet the\n\nrequirements of Sections 420 through 426.1 of this title or the\n\nOklahoma Medical Marijuana and Patient Protection Act as it relates\n\nto health and safety, the medical marijuana or medical marijuana\n\nproduct is handled in violation of applicable laws or rules and\n\nregulations promulgated by the Executive Director of the Authority,\n\nor the medical marijuana or medical marijuana product may be\n\npoisonous, deleterious to health or is otherwise unsafe, an\n\nelectronic or physical tag or other appropriate marking or hold\n\nshall be affixed to the medical marijuana or medical marijuana\n\nproduct which shall give notice that the medical marijuana or\n\nmedical marijuana product is or is suspected of being manufactured,\n\nproduced, transferred, sold or offered for sale in violation of\n\napplicable laws or rules and regulations promulgated by the\n\nExecutive Director and is embargoed. The notice shall further\n\nprovide a warning to all persons not to remove or dispose of the\n\nmedical marijuana or medical marijuana product until permission for\n\nremoval or disposal is given by the Executive Director. It shall be\n\nunlawful for any person to remove or dispose of the medical\n\nmarijuana or medical marijuana product embargoed without permission\n\nby the Executive Director.\n\nB. If the Executive Director finds that medical marijuana or\n\nmedical marijuana product embargoed pursuant to subsection A of this\n\nsection does not meet the requirements of applicable laws or rules\n\nand regulations promulgated by the Executive Director, or is\n\npoisonous, deleterious to health or otherwise unsafe, the Executive\n\nDirector may institute an action in the district court in whose\n\njurisdiction the medical marijuana or medical marijuana product is\n\nembargoed for the condemnation and destruction of the medical\n\nmarijuana or medical marijuana product. If the Executive Director\n\nfinds that the medical marijuana or medical marijuana product\n\nembargoed does meet the requirements of applicable laws and the\n\nrules and regulations promulgated by the Executive Director and is\n\nnot poisonous, deleterious to health or otherwise unsafe, the\n\nExecutive Director shall remove the embargo. In any court\n\nproceeding regarding an embargo, neither the Authority or the\n\nExecutive Director shall be held liable if the court finds\n\nreasonable belief for the embargo.\n\nC. Except as otherwise provided in subsection D of this\n\nsection, if the court finds that the embargoed medical marijuana or\n\nmedical marijuana product, in whole or in part, is in violation of\n\nany applicable laws or rules and regulations promulgated by the\n\nExecutive Director or is poisonous, deleterious to health or\n\notherwise unsafe, the medical marijuana or medical marijuana product\n\nshall be destroyed at the expense of the defendant under the\n\nsupervision of the Executive Director. All court costs, fees, costs\n\nof storage and disposal and other proper expenses shall be paid by\n\nthe defendant of the medical marijuana or medical marijuana product.\n\nD. The court may order that the medical marijuana or medical\n\nmarijuana product be delivered to the defendant for appropriate\n\nlabeling or processing under the supervision of the Executive\n\nDirector only if:\n\n1. The violation can be corrected by proper processing of\n\nmedical marijuana or medical marijuana product;\n\n2. All costs, fees and expenses have been paid; and\n\n3.
