The Oklahoma Medical Marijuana Authority shall require\n\nowners of medical marijuana facilities to submit their fingerprints\n\nto the Oklahoma State Bureau of Investigation (OSBI) for the purpose\n\nof conducting a state and federal fingerprint-based criminal\n\nbackground check.\n\nB. The Authority may require that such fingerprint submissions\n\nbe made as part of a medical marijuana facility application, a\n\nmedical marijuana facility renewal application, or an individual\n\napplication for a license or permit authorizing that individual to\n\nbe an owner of a medical marijuana facility.\n\nC. Fingerprint cards and any required fees shall be sent to the\n\nOSBI central repository. The fingerprint records shall be used for\n\nsearching the state criminal records repository and shall also be\n\nforwarded to the Federal Bureau of Investigation for a federal\n\ncriminal record search as provided in Section 150.9 of Title 74 of\n\nthe Oklahoma Statutes. The OSBI shall notify the Authority of any\n\ncriminal history record information or lack of criminal history\n\nrecord information discovered on the submitting individual.\n\nNotwithstanding the provisions of Section 150.9b of Title 74 of the\n\nOklahoma Statutes, all records related to any criminal history\n\ninformation discovered shall be accessible and available to the\n\nAuthority.\n\nD. As used in this section:\n\n1. “Medical marijuana facility” means an entity licensed or\n\ncertified by the Authority to acquire, cultivate, process,\n\nmanufacture, test, store, sell, transport, or deliver medical\n\nmarijuana; and\n\n2. “Owner” means a direct beneficial owner including all\n\npersons or entities, as follows:\n\na. all shareholders owning an interest of a corporate\n\nentity and all officers of a corporate entity,\n\nb. all partners of a general partnership,\n\nc. all general partners and all limited partners that own\n\nan interest in a limited partnership,\n\nd. all members that own an interest in a limited\n\nliability company,\n\ne. all beneficiaries that hold a beneficial interest in a\n\ntrust and all trustees of a trust,\n\nf. all persons or entities that own interest in a joint\n\nventure,\n\ng. all persons or entities that own an interest in an\n\nassociation,\n\nh. the owners of any other type of legal entity, and\n\ni. any other person holding an interest or convertible\n\nnote in any entity, which owns, operates, or manages a\n\nlicensed medical marijuana facility.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"30f7c8d9497127cd2828b27a579a03e6e7d1f97473284a491235e874ecf32741","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-427.26","next":"us-ok/okla.-stat.-tit.-63-63-427.28"},"notice":"GroundRules: Original legal text.
