McCarty Center for Children with Developmental","body":"Disabilities - Establishment and maintenance - Contracts - Payments\n\n- Power of Commission - Legal representation – Sale of surplus\n\nproperty and fixtures.\n\nA. The Oklahoma Cerebral Palsy Commission is hereby authorized\n\nand empowered to:\n\n1. Establish and maintain the J.D. McCarty Center for Children\n\nwith Developmental Disabilities, to provide care, maintenance,\n\ntraining, treatment, habilitation and rehabilitation of persons\n\nafflicted with cerebral palsy and other developmental disabilities\n\nwithin such institute;\n\n2. Set fees and charges for patient services;\n\n3. Provide care, maintenance, training, treatment and\n\nrehabilitation services to children not afflicted with cerebral\n\npalsy or developmental disabilities but who may benefit from the\n\nservices available from the J.D. McCarty Center for Children with\n\nDevelopmental Disabilities, as determined to be practicable by the\n\nOklahoma Cerebral Palsy Commission;\n\n4. Provide services to any adults who may benefit from services\n\navailable from the J.D. McCarty Center for Children with\n\nDevelopmental Disabilities, as determined to be practicable by the\n\nOklahoma Cerebral Palsy Commission; provided, that services to\n\nadults shall not diminish any services available to children;\n\n5. Enter into contracts for the purchase of real estate or\n\nother property and to buy or sell real estate, personal property and\n\nequipment necessary or incidental to the carrying out of the\n\nprovisions of Sections 485.1 through 485.11 of this title; and\n\n6. Enter into contracts with the Commission for Human Services\n\nand with other agencies of the state and of the counties in\n\nfurtherance of the provisions of Sections 485.1 through 485.11 of\n\nthis title; provided, the Oklahoma Cerebral Palsy Commission shall\n\nreceive from the Commission for Human Services payments aggregating\n\na minimum of One Hundred Thousand Dollars ($100,000.00) annually\n\nfrom funds set aside in the Children with Special Health Care Needs\n\nProgram; and provided further, the Oklahoma Cerebral Palsy\n\nCommission may negotiate with the Commission for Human Services or\n\nits successors for additional payments above One Hundred Thousand\n\nDollars ($100,000.00) from such funds.\n\nB. The Commission shall be charged with the duties of\n\nmanagement and control of the J.D. McCarty Center for Children with\n\nDevelopmental Disabilities and shall have power to sue or be sued in\n\nits own name.\n\nC. The Attorney General shall furnish the Commission with legal\n\nrepresentation. The Commission shall not contract for private legal\n\ncounsel except for extraordinary situations other than normal day-\n\nto-day situations, and when approved by the Attorney General.\n\nD. For the purposes of moving the J.D. McCarty Center for\n\nChildren with Developmental Disabilities to its new facilities, the\n\nOklahoma Cerebral Palsy Commission may sell surplus property and\n\nfixtures. Such sale of surplus property and fixtures shall be\n\nexempt from Sections 62.2 through 62.6 of Title 74 of the Oklahoma\n\nStatutes. The Commission shall sell such surplus property and\n\nfixtures at fair market value as determined by the members of the\n\nCommission. The process for the sale and transfer of title shall\n\noriginate with the Commission. All proceeds from such sale of the\n\nproperty and fixtures shall be deposited into the J.D.
