The Administrator of the Oklahoma Health Care Authority\n\nshall have the training and experience necessary for the\n\nadministration of the Authority. The Administrator shall be\n\nappointed by the Governor with the advice and consent of the Senate\n\nand shall serve at the pleasure of the Governor and may be removed\n\nor replaced without cause. Compensation for the Administrator shall\n\nbe determined by the Governor. The Administrator may be removed\n\nfrom office by a two-thirds (2/3) vote of the members elected to and\n\nconstituting each chamber of the Legislature.\n\nB. The Administrator of the Oklahoma Health Care Authority\n\nshall be the chief executive officer of the Authority and shall act\n\nfor the Authority in all matters except as may be otherwise provided\n\nby law. The powers and duties of the Administrator shall include\n\nbut not be limited to:\n\n1. Supervision of the activities of the Authority;\n\n2. Formulation and recommendation of rules for approval or\n\nrejection by the Oklahoma Health Care Authority Board and\n\nenforcement of rules and standards promulgated by the Board;\n\n3. Preparation of the plans, reports and proposals required by\n\nthe Oklahoma Health Care Authority Act, Section 5003 et seq. of this\n\ntitle, other reports as necessary and appropriate, and an annual\n\nbudget for the review and approval of the Board;\n\n4. Employment of such staff as may be necessary to perform the\n\nduties of the Authority including but not limited to an attorney to\n\nprovide legal assistance to the Authority for the state Medicaid\n\nprogram; and\n\n5. Establishment of a contract bidding process which:\n\na. encourages competition among entities contracting with\n\nthe Authority for state-purchased and state-subsidized\n\nhealth care; provided, however, the Authority may make\n\npatient volume adjustments to any managed care plan\n\nwhose prime contractor is a state-sponsored,\n\nnationally accredited medical school. The Authority\n\nmay also make education or research supplemental\n\npayments to state-sponsored, nationally accredited\n\nmedical schools based on the level of participation in\n\nany managed care plan by managed care plan\n\nparticipants,\n\nb. coincides with the state budgetary process, and\n\nc. specifies conditions for awarding contracts to any\n\ninsuring entity.\n\nC.
