On and after January 1, 1995, the Oklahoma Health Care\n\nAuthority shall be the designated state agency for the\n\nadministration of the Oklahoma Medicaid Program.\n\n1. The Authority shall contract with the Department of Human\n\nServices for the determination of Medicaid eligibility and other\n\nadministrative or operational functions related to the Oklahoma\n\nMedicaid Program as necessary and appropriate.\n\n2. To the extent possible and appropriate, upon the transfer of\n\nthe administration of the Oklahoma Medicaid Program, the Authority\n\nshall employ the personnel of the Medical Services Division of the\n\nDepartment of Human Services.\n\n3. The Department of Human Services and the Authority shall\n\njointly prepare a transition plan for the transfer of the\n\nadministration of the Oklahoma Medicaid Program to the Authority.\n\nThe transition plan shall include provisions for the retraining and\n\nreassignment of employees of the Department of Human Services\n\naffected by the transfer. The transition plan shall be submitted to\n\nthe Governor, the President Pro Tempore of the Senate and the\n\nSpeaker of the House of Representatives on or before January 1,\n\n1995.\n\nB. In order to provide adequate funding for the unique training\n\nand research purposes associated with the demonstration program\n\nconducted by the entity described in paragraph 7 of subsection B of\n\nSection 6201 of Title 74 of the Oklahoma Statutes, and to provide\n\nservices to persons without regard to their ability to pay, the\n\nOklahoma Health Care Authority shall analyze the feasibility of\n\nestablishing a Medicaid reimbursement methodology for nursing\n\nfacilities to provide a separate Medicaid payment rate sufficient to\n\ncover all costs allowable under Medicare principles of reimbursement\n\nfor the facility to be constructed or operated, or constructed and\n\noperated, by the organization described in paragraph 7 of subsection\n\nB of Section 6201 of Title 74 of the Oklahoma Statutes.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9f326b9425551be175b64933a956f2af94c29a0ccc37ba67437be7f36764b309","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-5008","next":"us-ok/okla.-stat.-tit.-63-63-5009.1"},"notice":"GroundRules: Original legal text.
