Stat. tit. 63, § 63-5013.2","heading":"Program to recognize family caregivers — Providing","body":"services to Medicaid members through a licensed home care agency —\n\nRequirements.\n\nA. As used in this section:\n\n1. “Family member” means a child, parent, parent-in-law,\n\nsibling, grandparent, grandchild, spouse, or any other individual\n\nrelated by blood, and any other individual with a close association\n\nthat is the equivalent of a family relationship; and\n\n2. “Home care agency” and “skilled care” have the same meanings\n\nas provided by Section 1-1961 of Title 63 of the Oklahoma Statutes.\n\nB. Not later than one year after the effective date of this act\n\nand subject to receipt of federal approval for the program, the\n\nOklahoma Health Care Authority shall establish a program under which\n\na family member of a Medicaid member may be recognized as a family\n\ncaregiver and, after receiving such recognition, may, under the\n\ndirection and supervision of a Registered Nurse, provide services to\n\nthe Medicaid member through a licensed home care agency under the\n\nreimbursement rates established under subsection F of this section,\n\nprovided that the Medicaid member is:\n\n1. Under the age of twenty-one (21) years; and\n\n2. Approved to receive private duty nursing services, or paid\n\nfamily caregiver benefits in lieu of private duty nursing services.\n\nC. 1. The program established under this section shall require\n\nthe family caregiver to fulfill such requirements or meet such\n\nqualifications as may be prescribed by the Oklahoma Health Care\n\nAuthority Board. Such requirements shall include, but not be\n\nlimited to, completion of a criminal history background check.\n\n2. The Board may prescribe standards for training, competency\n\nevaluation, and such other requirements or qualification criteria as\n\nthe Board deems necessary and appropriate.\n\nD. The Board shall establish scope of practice standards and\n\nrestrictions for services that a recognized family caregiver may\n\nprovide to a Medicaid enrollee. The scope of practice may include\n\nnecessary and appropriate skilled care tasks. In establishing such\n\nstandards and restrictions, the Board shall consider the advice of\n\nthe State Department of Health.\n\nE. It shall be the duty of the home care agency to ensure that\n\na recognized family caregiver meets the qualifications and\n\nrequirements prescribed by this section and rules promulgated by the\n\nBoard.\n\nF. Reimbursable services provided by a recognized family\n\ncaregiver under the program established under this section shall be\n\nreimbursed to a home care agency at a rate established by the\n\nAuthority.\n\nG. 1. The Board shall promulgate rules as necessary to\n\nimplement this section.\n\n2.
