There is hereby created in the State Treasury a fund for the\n\nOklahoma Health Care Authority to be designated the \"Rate\n\nPreservation Fund\". The fund shall be a continuing fund, not\n\nsubject to fiscal year limitations, and shall consist of monies\n\ndesignated to the fund by law. All monies accruing to the credit of\n\nthe fund are hereby appropriated and may be budgeted and expended by\n\nthe Authority for the purposes described in subsection B of this\n\nsection. Expenditures from the fund shall be made upon warrants\n\nissued by the State Treasurer against claims filed as prescribed by\n\nlaw with the Director of the Office of Management and Enterprise\n\nServices for approval and payment. The Administrator of the\n\nAuthority may request the Director of the Office of Management and\n\nEnterprise Services to transfer monies between the Rate Preservation\n\nFund and any other fund of the Authority as needed for the\n\nexpenditure of funds.\n\nB. The Oklahoma Health Care Authority is authorized to budget\n\nand expend monies from the Rate Preservation Fund as follows:\n\n1. For maintaining reimbursement rates to providers in the\n\nevent of a decrease in the state's Federal Medical Assistance\n\nPercentage rate; and\n\n2. Subject to the approval of the Director of the Office of\n\nManagement and Enterprise Services, the Oklahoma Health Care\n\nAuthority may transfer up to one-third (1/3) of the balance of the\n\nRate Preservation Fund in any given state fiscal year to other funds\n\nof the Authority to meet cash flow needs of the state's Medicaid\n\nprogram, so long as the monies are transferred back to the Rate\n\nPreservation Fund prior to the end of the state fiscal year in which\n\nthey were originally transferred.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fa9453f8a401156d5d81e51f5bb9ebafc1e16942f8179264c963ab2b3162d45e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-5020","next":"us-ok/okla.-stat.-tit.-63-63-5022.2"},"notice":"GroundRules: Original legal text.
