Effective July 1, 2001, the Oklahoma Health Care\n\nAuthority is authorized to offer to eligible contracted incorporated\n\nphysician providers, elective income deferral programs which can\n\nresult in federal income tax advantages and other advantages to such\n\nproviders and their employees. These deferral programs shall take\n\ninto account present and future provisions of the United States\n\nInternal Revenue Code which now or in the future might have the\n\nbeneficial effect of magnifying the after-tax value payments made by\n\nthe state to incorporated physician providers.\n\n2. The Oklahoma Health Care Authority may adopt a plan that\n\nprovides for the investment of deferral amounts in life insurance or\n\nannuity contracts which offer a choice of underlying investment\n\noptions. Contract-issuing companies shall be limited to companies\n\nthat are licensed to do business in this state.\n\n3. As a condition of participation in these income deferral\n\nprograms, all participating incorporated physician providers shall\n\nbe subject to provisions for forfeiture of benefits for failure to\n\nmaintain in force a Medicaid provider agreement and to furnish\n\nservices to Medicaid recipients for a specified duration.\n\nB. The Oklahoma Health Care Authority may consult with the\n\nState Treasurer and the Attorney General of the state for advice in\n\nestablishing the program.\n\nC.
