As used in this section “health care district” means a\n\nsubordinate health care entity that better promotes efficient\n\nadministration of health care service delivery for counties with a\n\npopulation of one hundred thousand (100,000) or less to eligible\n\npersons in this state.\n\nB. A locally designated health care district shall:\n\n1. Coordinate the delivery of health care services in local\n\njurisdictions such as municipalities and counties; provided,\n\nhowever, jurisdictions containing multiple areas shall be contiguous\n\nand shall possess commonality as it relates to need;\n\n2. Be authorized to adjust Medicaid provider rates above the\n\nstate minimum established by the Oklahoma Health Care Authority;\n\n3. Be authorized to contract with employer-sponsored health\n\nplans or private health plans to provide services to Medicaid and\n\nindigent beneficiaries; and\n\n4. Be authorized to expand health care services or health care\n\nproviders within health care districts.\n\nC. Health care districts may be established by local\n\ncommunities wherein locally generated tax dollars are received for\n\nthe benefit of local hospitals or other local health care services.\n\nThe districts shall have the same boundaries as the area over which\n\nthe locally assessed tax is levied.\n\nD. Health care districts may be established by the governing\n\nboards of the hospitals located within the area over which the\n\nlocally assessed tax for the benefit of the local hospital or other\n\nlocal health care service is levied. The governing board of the\n\nhospital shall be the governing board of the local health care\n\ndistrict.\n\nE. 1. Each health care district may certify to the Oklahoma\n\nHealth Care Authority the amount of funds generated by tax\n\nassessment within the health care district for the benefit of the\n\nlocal hospital or other local health care services.\n\n2. The Authority shall submit such information to the Centers\n\nfor Medicare and Medicaid Services (CMS) for the purpose of applying\n\nfor federal matching funds. The Authority shall submit any\n\nnecessary applications for waivers to accomplish the provisions of\n\nthis act.\n\nF. The Oklahoma Health Care Authority Board is hereby directed\n\nto promulgate rules to enact the provisions of this section. The\n\nrules shall, at a minimum, address:\n\n1. Internal establishment of local health care district\n\naccounts within the Authority including, but not limited to,\n\nprocedures for remitting funds out of such accounts back to the\n\nlocal health care district; and\n\n2. Methods for certifying funds for each local health care\n\ndistrict and for reporting such amounts to the Centers for Medicare\n\nand Medicaid Services for federal matching purposes. The revenue\n\nfor each health care district account shall consist of federal\n\nmatching dollars received for such certified funds.\n\nThe Oklahoma Health Care Authority shall apply for federal\n\nmatching funds based on the amount of funds certified by the local\n\nhealth care district for such purposes. The Authority shall not\n\nreduce the amount of disbursements otherwise due to a health care\n\ndistrict based on the health care district’s receipt of the local\n\narea dedicated monies and any attributable federal matching funds;\n\nand\n\n3.
