There is hereby created within the Oklahoma Health Care\n\nAuthority the Medicaid Drug Utilization Review Board, which shall be\n\nresponsible for the development, implementation and assessment of\n\nretrospective and prospective drug utilization programs under the\n\ndirection of the Authority.\n\nB. The Medicaid Drug Utilization Review Board shall consist of\n\nten (10) members appointed by the administrator of the Authority as\n\nfollows:\n\n1. Four physicians, licensed and actively engaged in the\n\npractice of medicine or osteopathic medicine in this state, of\n\nwhich:\n\na. three shall be physicians chosen from a list of not\n\nless than six names submitted by the Oklahoma State\n\nMedical Association, and\n\nb. one shall be a physician chosen from a list of not\n\nless than two names submitted by the Oklahoma\n\nOsteopathic Association;\n\n2. Four licensed pharmacists actively engaged in the practice\n\nof pharmacy, chosen from a list of not less than six names submitted\n\nby the Oklahoma Pharmaceutical Association;\n\n3. One person representing the lay community, who shall not be\n\na physician or a pharmacist, but shall be a health care professional\n\nwith recognized knowledge and expertise in at least one of the\n\nfollowing:\n\na. clinically appropriate prescribing of covered\n\noutpatient drugs,\n\nb. clinically appropriate dispensing and monitoring of\n\ncovered outpatient drugs,\n\nc. drug use review, evaluation and intervention, and\n\nd. medical quality assurance; and\n\n4. One person representing the pharmaceutical industry who is a\n\nresident of the State of Oklahoma, chosen from a list of not less\n\nthan two names submitted by the Pharmaceutical Research and\n\nManufacturers of America. The member representing the\n\npharmaceutical industry shall be prohibited from voting on action\n\nitems involving drugs or classes of drugs.\n\nC. Members shall serve terms of three (3) years, except that\n\none physician, one pharmacist and the lay representative shall each\n\nbe initially appointed for two-year terms in order to stagger the\n\nterms. In making the appointments, the administrator shall provide,\n\nto the extent possible, for geographic balance in the representation\n\non the Medicaid Drug Utilization Review Board. Members may be\n\nreappointed for a period not to exceed three three-year terms and\n\none partial term. Vacancies on the Medicaid Drug Utilization Review\n\nBoard shall be filled for the balance of the unexpired term from new\n\nlists submitted by the entity originally submitting the list for the\n\nposition vacated.\n\nD. The Medicaid Drug Utilization Review Board shall elect from\n\namong its members a chair and a vice-chair who shall serve one-year\n\nterms, provided they may succeed themselves.\n\nE. The proceedings of all meetings of the Medicaid Drug\n\nUtilization Review Board shall comply with the provisions of the\n\nOklahoma Open Meeting Act and shall be subject to the provisions of\n\nthe Administrative Procedures Act.\n\nF. The Medicaid Drug Utilization Review Board may advise and\n\nmake recommendations to the Authority regarding existing, proposed\n\nand emergency rules governing retrospective and prospective drug\n\nutilization programs.
