Stat. tit. 63, § 63-5053.2","heading":"Civil actions by Attorney General or individual persons","body":"authorized - Complaint procedure.\n\nA. The Attorney General shall diligently investigate a\n\nviolation under the Oklahoma Medicaid False Claims Act. If the\n\nAttorney General finds that a person has violated or is violating\n\nthe Oklahoma Medicaid False Claims Act, the Attorney General may\n\nbring a civil action under this section against the person.\n\nB. 1. A person may bring a civil action for a violation of the\n\nOklahoma Medicaid False Claims Act for the person and for this\n\nstate. The action shall be brought in the name of the state. The\n\naction may be dismissed only if the court and the Attorney General\n\ngive written consent to the dismissal and state the reasons for\n\nconsenting.\n\n2. A copy of the complaint and written disclosure of\n\nsubstantially all material evidence and information the person\n\npossesses shall be served on the state pursuant to Section 2004 of\n\nTitle 12 of the Oklahoma Statutes. The complaint shall be filed in\n\ncamera, shall remain under seal for at least sixty (60) days, and\n\nshall not be served on the defendant until the court so orders. The\n\nstate may elect to intervene and proceed with the action within\n\nsixty (60) days after it receives both the complaint and the\n\nmaterial evidence and information.\n\n3. The state may, for good cause shown, move the court for\n\nextensions of the time during which the complaint remains under seal\n\nunder paragraph 2 of this subsection. Any such motions may be\n\nsupported by affidavits or other submissions in camera. The\n\ndefendant shall not be required to respond to any complaint filed\n\nunder this section until twenty (20) days after the complaint is\n\nunsealed and served upon the defendant pursuant to Section 2004 of\n\nTitle 12 of the Oklahoma Statutes.\n\n4. Before the expiration of the sixty-day period or any\n\nextensions obtained under paragraph 3 of this subsection, the state\n\nshall:\n\na. proceed with the action, in which case the action\n\nshall be conducted by the state, or\n\nb. notify the court that it declines to take over the\n\naction, in which case the person bringing the action\n\nshall have the right to conduct the action.\n\n5.
