A subpoena requiring the attendance of a witness at a trial\n\nor hearing conducted under the Oklahoma Medicaid False Claims Act\n\nmay be served at any place in Oklahoma.\n\nB. A civil action under Section 5053.2 of this title may not be\n\nbrought:\n\n1. More than six (6) years after the date on which the\n\nviolation of the Oklahoma Medicaid False Claims Act is committed; or\n\n2. More than three (3) years after the date when facts material\n\nto the right of action are known or reasonably should have been\n\nknown by the official of the State of Oklahoma charged with\n\nresponsibility to act in the circumstances, but in no event more\n\nthan ten (10) years after the date on which the violation is\n\ncommitted, whichever occurs last.\n\nC. If the state elects to intervene and proceed with an action\n\nbrought under Section 5053.2 of this title, the state may file its\n\nown complaint or amend the complaint of a person who has brought an\n\naction under Section 5053.2 of this title to clarify or add detail\n\nto the claims in which the state is intervening and to add any\n\nadditional claims with respect to which the state contends it is\n\nentitled to relief. For statute of limitations purposes, any such\n\nstate pleading shall relate back to the filing date of the complaint\n\nof the person who originally brought the action to the extent that\n\nthe claim of the state arises out of the conduct, transactions or\n\noccurrences set forth, or attempted to be set forth, in the prior\n\ncomplaint of the person.\n\nD. In any action brought under Section 5053.2 of this title,\n\nthis state shall be required to prove all essential elements of the\n\ncause of action, including damages, by a preponderance of the\n\nevidence.\n\nE. Notwithstanding any other provision of law, a final judgment\n\nrendered in favor of this state in any criminal proceeding charging\n\nfraud or false statements, whether upon a verdict after trial or\n\nupon a plea of guilty or nolo contendere, shall estop the defendant\n\nfrom denying the essential elements of the offense in any action\n\nwhich involves the same transaction as in the criminal proceeding\n\nand which is brought under the Oklahoma Medicaid False Claims Act.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ccadbb8f03c1912cdf35860cd4319c921c1e84446f689d52992345cf3b6b39fc","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-5053.5","next":"us-ok/okla.-stat.-tit.-63-63-5053.7"},"notice":"GroundRules: Original legal text.
