Stat. tit. 63, § 63-6403","heading":"Activation of disaster response and recovery aspects of","body":"emergency plans – Powers of Governor.\n\nA. The declaration of a state of catastrophic health emergency\n\nshall activate the disaster response and recovery aspects of the\n\nstate, local, and inter-jurisdictional disaster emergency plans in\n\nthe affected political subdivisions or geographic areas. Such\n\ndeclaration authorizes the deployment and use of any forces to which\n\nthe plans apply and the use or distribution of any supplies,\n\nequipment, and materials and facilities assembled, stockpiled, or\n\navailable pursuant to this act.\n\nB. During a state of catastrophic health emergency, the\n\nGovernor may:\n\n1. Suspend the provisions of any regulatory statute prescribing\n\nprocedures for conducting state business, or the orders and rules of\n\nany state agency, to the extent that strict compliance with the same\n\nwould prevent, hinder, or delay necessary action (including\n\nemergency purchases) by the public health authority to respond to\n\nthe catastrophic health emergency, or increase the health threat to\n\nthe population;\n\n2. Utilize all available resources of the state government and\n\nits political subdivisions, as reasonably necessary to respond to\n\nthe catastrophic health emergency;\n\n3. Transfer the direction, personnel, or functions of state\n\ndepartments and agencies in order to perform or facilitate response\n\nand recovery programs regarding the catastrophic health emergency;\n\n4. Mobilize all or any part of the National Guard into service\n\nof the state. An order directing the National Guard to report for\n\nactive duty shall state the purpose for which it is mobilized and\n\nthe objectives to be accomplished;\n\n5. Provide aid to and seek aid from other states during the\n\ncatastrophic health emergency in accordance with any interstate\n\nemergency compact made with this state; and\n\n6. Seek aid from the federal government for the catastrophic\n\nhealth emergency in accordance with federal programs or\n\nrequirements.\n\nC. The public health authority shall coordinate all matters\n\npertaining to the catastrophic health emergency response of the\n\nstate. The public health authority shall have primary jurisdiction,\n\nresponsibility, and authority for:\n\n1. Planning and executing catastrophic health emergency\n\nassessment, mitigation, preparedness response, and recovery for the\n\nstate;\n\n2. Coordinating catastrophic health emergency response between\n\nstate and local authorities during a catastrophic health emergency;\n\n3. Collaborating with relevant federal government authorities,\n\nelected officials of other states, private organizations or\n\ncompanies during a catastrophic health emergency;\n\n4. Coordinating recovery operations and mitigation initiatives\n\nsubsequent to catastrophic health emergencies; and\n\n5. Organizing public information activities regarding\n\ncatastrophic health emergency response operations.\n\nD. After the declaration of a state of catastrophic health\n\nemergency, special identification for all public health personnel\n\nworking during the catastrophic health emergency shall be issued as\n\nsoon as possible. The identification shall indicate the authority\n\nof the bearer to exercise public health functions and emergency\n\npowers during the state of catastrophic health emergency.
