Stat. tit. 63, § 63-6406","heading":"Short title - COVID-19 Public Health Emergency Limited","body":"Liability Act – Purpose – Liability limitations.\n\nA. This act shall be known and may be cited as the \"COVID-19\n\nPublic Health Emergency Limited Liability Act\".\n\nB. For purposes of the COVID-19 Public Health Emergency Limited\n\nLiability Act:\n\n1. \"COVID-19 public health emergency\" means any emergency\n\ndeclared by the Governor of Oklahoma related to COVID-19, including\n\nbut not limited to the emergency declared by the Governor by\n\nExecutive Order 2020-07, and any amendments thereto, under the\n\nOklahoma Emergency Management Act of 2003, Section 683.1 et seq. of\n\nTitle 63 of the Oklahoma Statutes, beginning on March 15, 2020, and\n\nthe health emergency declared by the Governor by Executive Order\n\n2020-13, and any amendments thereto, under the Catastrophic Health\n\nEmergency Powers Act, Section 6101 et seq. of Title 63 of the\n\nOklahoma Statutes, beginning on April 8, 2020;\n\n2. \"Health care facility\" and \"health care provider\" shall have\n\nthe same meaning as such terms are defined as provided in Section\n\n6104 of Title 63 of the Oklahoma Statutes; and\n\n3. \"Health care services\" means any services provided by a\n\nhealth care facility, health care provider, or by an individual\n\nworking under the supervision of a health care facility or provider,\n\nthat relate to the diagnosis, assessment, prevention, treatment,\n\naid, shelter, assistance, or care of illness, disease, injury, or\n\ncondition.\n\nC. A health care facility or health care provider shall be\n\nimmune from civil liability for any loss or harm to a person with a\n\nsuspected or confirmed diagnosis of COVID-19 caused by an act or\n\nomission by the facility or provider that occurs during the COVID-19\n\npublic health emergency, if:\n\n1. The act or omission occurred in the course of arranging for\n\nor providing COVID-19 health care services for the treatment of the\n\nperson who was impacted by the decisions, activities or staffing of,\n\nor the availability or capacity of space or equipment by, the health\n\ncare facility or provider in response to or as a result of the\n\nCOVID-19 public health emergency; and\n\n2. The act or omission was not the result of gross negligence\n\nor willful or wanton misconduct of the health care facility or\n\nhealth care provider rendering the health care services.\n\nD. In no event shall this act be construed to grant immunity\n\nfrom civil liability for an act or omission in the provision of\n\nhealth care services to a person who did not have a suspected or\n\nconfirmed diagnosis of COVID-19 at the time of the services.\n\nE. This act shall apply to any civil action filed on or after\n\nthe effective date of this act. The provisions of this act shall be\n\nin effect until October 31, 2020, or until such time as the Governor\n\naffirmatively concludes the emergency declarations specified in\n\nparagraph 1 of subsection B of this section, whichever is later.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9fdcea05f8bdf30257d75bb3b1cb8ccbd1faeaeae0ec1ae1d000862922561a0c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-6405","next":"us-ok/okla.-stat.-tit.-63-63-6501"},"notice":"GroundRules: Original legal text.
