The public health authority may exercise, for such period as\n\nthe state of catastrophic health emergency exists, the following\n\npowers regarding the safe disposal of contaminated waste:\n\n1. To adopt and enforce measures to provide for the safe\n\ndisposal of contaminated waste as may be reasonable and necessary to\n\nrespond to the catastrophic health emergency. Such measures may\n\ninclude, but are not limited to, the collection, storage, handling,\n\ndestruction, treatment, transportation, and disposal of contaminated\n\nwaste; and\n\n2. To require any business or facility authorized to collect,\n\nstore, handle, destroy, treat, transport, and dispose of\n\ncontaminated waste under the laws of this state, and any landfill\n\nbusiness or other such property, to accept contaminated waste, or\n\nprovide services or the use of the business, facility, or property\n\nif such action is reasonable and necessary to respond to the\n\ncatastrophic health emergency as a condition of licensure,\n\nauthorization, or the ability to continue doing business in the\n\nstate as such a business or facility. The use of the business,\n\nfacility, or property may include transferring the management and\n\nsupervision of such business, facility, or property to the public\n\nhealth authority for a period of time, which shall not exceed the\n\ntermination of the declaration of a state of catastrophic health\n\nemergency.\n\nB.
