As used in this section:\n\n1. “Department” means the State Department of Health,\n\nBioterrorism Division;\n\n2. “Director” means the Commissioner of Health;\n\n3. “Bioterrorism” means the intentional use of any\n\nmicroorganism, virus, infectious substance or biological product\n\nthat may be engineered as a result of biotechnology or any naturally\n\noccurring or bioengineered component of any microorganism, virus,\n\ninfectious substance or biological product, to cause or attempt to\n\ncause death, disease or other biological malfunction in any living\n\norganism;\n\n4. “Disaster locations” means any geographical location where a\n\nbioterrorism attack, terrorist attack, catastrophic or natural\n\ndisaster or emergency occurs; and\n\n5. “First responders” means state and local law enforcement\n\npersonnel, fire department personnel and emergency medical personnel\n\nwho will be deployed to bioterrorism attacks, terrorist attacks,\n\ncatastrophic or natural disasters and emergencies.\n\nB. The Department shall offer a vaccination program for first\n\nresponders who may be exposed to infectious diseases when deployed\n\nto disaster locations. The vaccinations shall include, but are not\n\nlimited to, hepatitis B vaccination, diphtheria-tetanus vaccination,\n\ninfluenza vaccination, and other vaccinations when recommended by\n\nthe United States Public Health Service and in accordance with\n\nFederal Emergency Management Directors Policy. Immune globulin will\n\nbe made available when necessary.\n\nC. Participation in the vaccination program will be voluntary\n\nby the first responders, except for first responders who are\n\nclassified as having “occupational exposure” to bloodborne pathogens\n\nas defined by the Occupational Safety and Health Administration\n\nStandard contained at 29 CFR 1910.1030. First responders who are\n\nclassified as having “occupational exposure” to bloodborne pathogens\n\nshall be required to take the designated vaccinations.\n\nD. A first responder shall be exempt from vaccinations when a\n\nwritten statement from a licensed physician is presented indicating\n\nthat a vaccine is medically contraindicated for that person or the\n\nfirst responder signs a written statement that the administration of\n\na vaccination conflicts with their religious tenets.\n\nE. In the event of a vaccine shortage, the Director, in\n\nconsultation with the Governor and the Centers for Disease Control\n\nand Prevention, shall give priority for vaccination to first\n\nresponders.\n\nF. The Department shall notify first responders of the\n\navailability of the vaccination program and shall provide\n\neducational materials on ways to prevent exposure to infectious\n\ndiseases.\n\nG. The Department may contract with county and local health\n\ndepartments, not-for-profit home health care agencies, hospitals and\n\nphysicians to administer a vaccination program for first responders.\n\nH. This section shall be effective upon receipt of federal\n\nfunding and/or federal grants for administering a first responders\n\nvaccination program. Upon receipt of such funding, the Department\n\nshall make available the vaccines to first responders as provided in\n\nthis section.
